About this file

This document is a Justification & Approval (J&A) for Other Than Full and Open Competition for a simplified acquisition over the micropurchase threshold up to the Simplified Acquisition Threshold. The National Park Service at Lassen Volcanic National Park requires repairs to an existing water tank at the Manzanita Lake Campground that was damaged by a fallen tree. The repair work involves replacing two steel side panels and two roof panels. The total anticipated cost is unknown.

The sole source justification is that the existing water tank is of proprietary design, and there is only one manufacturer (Aquastore) that makes the required parts. California Aquastore is the factory authorized distributor and installer for Aquastore products in California and Nevada. A market research was conducted, and a synopsis was posted on SAM.gov, but no other responses were received. The contracting officer determined that it is more cost effective to repair the existing tank rather than replace it.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR

Part 2) UP TO SAT (See FAR 13.106-1)

Date: March 27, 2024 PR Number: 0040658524

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The National Park Service (NPS) at Lassen Volcanic National Park (LAVO) has a requirement to repair an existing water tank located at Manzanita Lake Campground that was damaged in February of 2024 when a large tree fell on the tank and damaged several tank and roof panels. The repair work consists of removing and replacing two steel side panels and two roof panels. The total anticipated cost is

2. Sole Source Justification rationale (Check one and explain below):

X_____ Only one responsible source.

______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

______ Other _____________________________________________________

Explain: The existing water tank is of proprietary design. There is only one manufacturer (Aquastore) that makes the required parts. California Aquastore located at 2121 Marshal Trail, South Lake Tahoe, CA 96150 is the factory authorized distributor and installer of Aquastore storage tanks and other CST Industries, Inc. products throughout California and Northern Nevada. It is far less expensive to repair the existing tank as opposed to replacement.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

A market survey was conducted. On April 29, 2024, the contracting officer issued a synopsis of the proposed contract action (special notice of intent to sole source) to the Contract Opportunities module of www.sam.gov, which described the requirement and the reasoning to sole source to California Aquastore, and alerted any firm that believed it had the capabilities to provide the required services to contact the contracting officer for consideration. The special notice closed on May 14, 2024 with no responses received. No other offers were received nor did anyone express interest.
