About this file

This document is a Justification for Other Than Full and Open Competition (J&A) for the Department of Justice - Bureau of Prisons, specifically the Federal Correctional Institution (FCI) in Otisville, NY. The action seeks to acquire tipping fees with Orange County Landfill from May 1st, 2024, through September 31st, 2025, for institutional waste disposal. The justification cites FAR 6.302-2 as the statutory authority, noting that this landfill is the only local option within a 60-mile radius, making it impractical and financially nonsensical to transport waste further away.

The market research confirmed no alternative landfills within the specified radius, and the existing landfill has been used by the institution for decades. The contracting officer determined the anticipated cost to be fair and reasonable, as New York State tipping fees align with Orange County Landfill's charges. The document includes a certification by George Bodine, Contract Officer at FCI Otisville, who commits to conducting a future search for potential new landfills that might be developed in the area.
