Export Import Bank of the US
About this file
This is a Justification and Approval for Other Than Full and Open Competition document issued by the Export-Import Bank of the United States (EXIM) Office of Contracting Services for a commercial legal services acquisition.
EXIM is awarding a new Firm Fixed Price purchase order to Nieves Lliteras y Asociados, S.C., a legal services firm, to provide legal recovery services for two defaulted loan claims in Mexico (claims I200475 and I200549). The contractor will perform asset searches, site visits, negotiations, litigation, documentation of agreements, asset embargoes, and asset executions to collect outstanding amounts owed to EXIM by obligors and guarantors. The contract replaces the expiring contract number 83310121P0026 and carries a five-year period of performance. The estimated contract value pertains to recovery fees calculated as a percentage of recovery amounts, with specific dollar figures redacted in the document. The Contracting Officer justifies the single-source award under FAR 6.302-1 (Only One Responsible Source), citing the contractor's unique qualifications including extensive experience with complex U.S. Government administrative requirements, certification to practice under Mexican jurisdiction law, demonstrated competence in EXIM's advisory and documentary processes, knowledge of EXIM policies and procedures, and expertise in Mexican litigation and collection matters. The contractor is registered in the System for Award Management (SAM). The justification emphasizes that time-sensitive assignment of new claims to local counsel is critical, as delays between claim filing and collection efforts can exceed one year, allowing debtors to conceal assets or transfer funds. No other sources expressed written interest in the acquisition.

By the time an insured files a claim with EXIM Bank and the time that it is reviewed by the Claim Processing unit and paid by the OCFO a few months at least may have lapsed, not taking into consideration the time from the last shipment to the buyer, which could very well add nine months to the process. By the time the RO receives the claim for collection close to one year may have gone by before any attempt is made to collect from the foreign buyer, a definite disadvantage to the taxpayer. A debtor may be in hiding, it could have sold the company/operating under a different name, it may have transferred assets to avoid collection, its financial condition may have suddenly changed and/or its local currency may have depreciated. only a handful of contractors that understand the scope of recovery work required by EXIM Bank.

Offerors are located through SAM registry, U.S. Embassy contacts, conferences, with the ability to work in recovery matters in Mexico.
