About this file

This document contains a justification of other than full and open competition (JOFOC) for the award of a sole source contract. The contract is for 364 male calves with specific genotypic and phenotypic traits from the University of Nebraska to the USDA Agricultural Research Service at their facility in Clay Center, Nebraska. Due to biosafety concerns, the research facility does not allow animals from outside sources. The university has a long-standing cooperative relationship with the research facility, and as the only source that can supply animals to the location, a sole source award is justified. The anticipated award is for an unknown amount to an unknown vendor, with an award date of January 29, 2021. Market research found the proposed pricing to be fair and reasonable compared to previous contracts.

6. Beta Sam.GOV (GPE) Announcement/Potential Sources A sources sought announcement was placed on the Government Point of Entry (GPE) beta.Sam.gov on November 20, 2020. The sources sought requested all interested vendors who could potentially provide these unique males calves with the appropriate genotypic and phenotypic traits to respond to the posting with a capabilities statement or brief. The Government received 0 (zero) responses to the sources sought notice.

Additionally a Notice of Intent to issue a Sole Source Award was also posted on beta.Sam.gov and we received 0 (zero) responses to that Pre-solicitation Notice of Intent Posting as well. No other potential sources were able to be obtained through the announcements.

7. Determination of Fair and Reasonable Cost The cost will be evaluated in accordance with FAR 15.404-1(b), utilizing market research, Federal Procurement Data System (FPDS), and the Independent Government Estimate (IGE).

8. Market Survey Market Research found that according to CattleFax, the cost for a steer that weighs 378 lbs (Average weight of cattle required), costs $ which was the cost offered to USDA by the University of Nebraska. Last year on PO # 12653820P0013, the Location paid $ . This year's costs are only $ , just a slight increase from last year, therefore when comparing historical prices the costs offered to the USDA are considered fair and reasonable. Due to biosafety concerns, no other sources may be considered.

9. Additional Support 364 male calves that have the appropriate genotypic and phenotypic traits must come from the University of Nebraska Lincoln for biosafety reasons.

10. Other Interested Sources

No responses have been received that would allow the USDA to identify any other potential sources of the 364 male calves.

11. Actions Taken to Remove Barriers to Future Competition The future competition for this requirement is not planned because this JOFOC covers all known requirements for the 364 calves needed at USMARC in Clay Center, NE. Given the proprietary nature of these calves having the appropriate genotypic and phenotypic traits and due to biosafety reasons at USMARC, there will not be future competition, however, the Government will continually monitor industry for possible alternatives.
