About this file
This is a Justification for Other Than Full and Open Competition (J&A) document submitted by the Federal Bureau of Prisons for a procurement action at Federal Correctional Institution Berlin, New Hampshire.
The procurement is for repair services on a chiller unit located in the FCI Berlin Utility Plant, with an estimated value of $6,834.00. The chiller experienced complete failure between July 11-14, 2026, requiring a site visit by the manufacturer to diagnose the problem and develop an action plan to restore the unit to operational status. The Federal Bureau of Prisons determined that only Daikin Applied, as the sole responsible source, can provide the necessary repair services, justifying the award without full and open competition under RFO 6.103-1 and 41 U.S.C. 3304(a)(1). The justification cites the urgent and compelling nature of the requirement, as operational air conditioning is vital to maintaining a healthy and safe environment for inmates and staff at the facility, with potential health risks if temperatures exceed 90 degrees Fahrenheit. Due to the time-sensitive nature, no formal market survey was conducted and the requirement was not posted to SAM.GOV. The Contracting Officer determined the pricing from Daikin Applied to be fair and reasonable, in line with industry standards. The document was submitted and digitally signed by Jessalynn Laflamme, Property & Procurement Specialist, on July 21, 2026.
