About this file

This is a Justification for Other than Full and Open Competition (JOFOC) document supporting a sole source acquisition by the National Institutes of Health Clinical Center Pharmacy Department. The NIH intends to award a one-year firm fixed-price contract beginning in June 2026 to Central Admixture Pharmacy Services, Inc. (CAPS, Inc.), located in Philadelphia, Pennsylvania, for the purchase of compounded Total Parenteral Nutrition (TPN) and other compounded sterile products for patient care. The justification cites 41 U.S.C. 3304(a)(1) under FAR 6.302-1, asserting that only one responsible source is available because CAPS is the original manufacturer and has not designated other distributors for these compounded products in the United States. Pricing is established by the manufacturer through their order portal and prior invoices, with fair and reasonable pricing determined against historical invoicing data.

The acquisition is classified as support services (non-R&D) under NAICS Code 325412 (Pharmaceutical Preparation Manufacturing) and PSC 6515 (Medical and Surgical Instruments, Equipment, and Supplies). The Contracting Officer of Record is Fortin Georges, and the sponsoring organization is the Clinical Center Pharmacy Department under the supervision of Saly Gabriel, Chief of Pharmacy. The document notes that no market research was conducted due to only two responses being available, though the CC Pharmacy Department maintains industry awareness through trade shows, seminars, and trade journals. The justification indicates that no other vendors have expressed written interest in the acquisition, and the agency commits to monitoring market conditions and new government-wide acquisition contracts (GWACs) and pricing agreements (PBAs) to assess whether alternative distribution channels emerge for future acquisitions.
