About this file
This Justification for Other Than Full and Open Competition (JOFOC) document details a sole-source contract for the Department of Veterans Affairs National Cemetery Administration. Regimental Contracting LLC will perform raising, realigning, and cleaning headstones and turf renovation in multiple sections at Calverton National Cemetery, with a total estimated value of $3,484,115 and an 18-month performance period. The contract is being awarded as a sole-source procurement under FAR 6.302-5 and VAAR 819.7008 for a certified service-disabled veteran-owned small business (SDVOSB), leveraging the contractor's existing familiarity with the site from their ongoing FY24 Shrine project.
The justification emphasizes Regimental Contracting's exceptional past performance, proximity (within 50 miles of the cemetery), and current mobilization at the site. Despite attempts to increase competition through SAM.gov posting, no other vendors responded. The contracting office determined the pricing to be fair and reasonable based on the contractor's previous work, and the procurement is considered a one-time requirement with commitments to enhance future competitive efforts through more extensive market research and industry engagement.

FAR 6.302-7: Public interest, 41 U.S.C. 3304(a)(7).
5. Reason for Authority Cited: The justification for restricting competition and awarding a sole source contract to Regimental Contracting, LLC for the FY25 Shrine project at Calverton National Cemetery due to their demonstrated exceptional past performance and proven familiarity with the site conditions.
Regimental Contracting, LLC is currently on site for the FY24 Shrine project at the same cemetery, showcasing their ability to deliver high-quality work on time and within budget. Their prior experience at this site means they are well-versed in the specific requirements and challenges posed by the limited space in the staging area. Additionally, they are already mobilized at Calverton National Cemetery, ensuring a seamless continuation of work. This continuity not only minimizes disruptions but also aligns with the Government's best interest by leveraging their established presence and expertise for the successful execution of the FY25 Shrine project. They are also located within 50 miles of the cemetery.
6. Actions to Increase Competition: For the FY25 Shrine Project at Calverton National Cemetery, actions were taken to solicit interest from multiple potential sources. The following steps were or will be undertaken in alignment with FAR Subpart 5.2 to publicize the requirement. A notice of the solicitation was or will be posted on the Government's official procurement website, SAM.gov, as required by FAR Subpart 5.2. This notice details the scope of work, including raising, realigning, and cleaning headstones, as well as turf renovation in multiple sections at the Cemetery. No one responded. Though this procurement action is a one-time requirement, the agency commits to future efforts aimed at increasing competition for similar acquisitions by enhancing vendor outreach and market research. Future similar projects will involve more extensive market surveys and industry days to proactively identify and engage potential service providers capable of meeting our specialized requirements.
7. Market Research: In consideration of the unique requirements and specialized nature of the services for the FY25 Shrine Project at Calverton, a formal market research process was not conducted for this procurement. This decision is justified based on the familiarity of Regimental’s work. Regimental has previously completed similar work at Calverton National Cemetery and other cemeteries with exemplary results. Their prior successful performance has demonstrated their technical capability, reliability, and understanding of the specificities involved in handling headstone realignment, cleaning, and turf renovation in a cemetery setting.
8. Fair and Reasonable Price Determination: As the Contracting Officer, I, hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable and is in the overall best interest of the Government. Regimental typically provided reasonable pricing in this area of work.
