About this file
This document is a Justification for Other Than Full and Open Competition for landfill services at the Federal Correctional Institution (FCI) Berlin in New Hampshire. The Federal Bureau of Prisons requires landfill services for two dumpsters from Androscoggin Valley Regional Refuse (AVRRDD), the sole provider in the Coos County area, for a short period from October 22-24, 2025. The total estimated cost is $3,752.00, which the Contracting Officer has determined to be fair and reasonable based on consistent pricing from the previous fiscal year.
The justification highlights that AVRRDD is the only landfill service within a reasonable 3-mile distance from FCI Berlin, with the next closest alternative in Conway, NH being a 45-minute drive each way through two mountain ranges. Due to the severe winters and potential safety and cost concerns, the agency is pursuing a sole-source procurement under FAR 6.302-1(a)(2), which allows for acquisition from the only responsible source that can satisfy agency requirements. The market research conducted by the Facilities Manager confirmed AVRRDD as the only viable landfill service provider for the institution.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
LANDFILL SERVICE
Pursuant to the Federal Acquisition Regulation (FAR) Subpart 6.303-2(b), and the Bureau of Prisons Acquisition Policy (BPAP) Part 6.304(a), the Federal Bureau of Prisons (BOP) has determined that the procurement of landfill services is a complex requirement of the Federal Correctional Institution in Berlin, New Hampshire and meets the criteria established for justification for other than full and open competition.
It is further determined that only one responsible source and no other supplies and/or services will satisfy agency requirements. This limitation on competition is justified as supported by the following information:
1. Agency:
Federal Bureau of Prisons Federal Correctional Institution Berlin (FCI Berlin) 1 Success Loop Rd Berlin, NH 03570
2. FAR 6.303-2(b)(2): Nature and/or description of the action being approved:
This action is for the acquisition of landfill services for two dumpsters supplied to FCI Berlin from the sole provider of such services. Pursuant to FAR Part 41 for October 22, 2025 to October 24, 2025, FY-2026.
3. FAR 6.303-2(b)(3): Description of supplies or services required to meet the agency needs:
The contractor shall provide landfill services for the period of October 22, 2025, through October 24, 2025. The total estimated amount for landfill service is $3,752.00.
4. FAR 6.303-2(b)(4): An identification of the statutory authority permitting other than full and open competition:
41 U.S.C. 3304(a)(1) per FAR 6.302-1(a)(2) - Only one responsible source and no other supplies or services will satisfy agency requirements.
5. FAR 6.303-2(b)(5): Determination that proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The contractor, Androscoggin Valley Regional Refuse (AVRRDD), is the sole provider of landfill services in the Berlin, NH service area of Coos County. The next closest landfill to FCI Berlin is Conway, NH. This would involve a drive of 45 minutes each way. Due to the severe winters in the Northeast area, it would not be safe to cross through two mountain ranges, nor cost effective to deliver landfill waste that distance. The landfill service FCI Berlin receives locally is approximately 3 miles from the institution.
6. FAR 6.303-2(b)(6): Efforts made to solicit from as many potential sources are practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies.
The government point of entry (GPE), www.fbo.gov., was not utilized due the fact that FAR 5.202 (13) The proposed contract action(i) Is for an amount not expected to exceed the simplified acquisition threshold;
7. FAR 6.303-2(b)(7): Contracting Officer’s determination that the cost to the government will be fair and reasonable:
The Contracting Officer has determined that the estimated price of $3,752.00 for October 22, 2025 to October 24,2025 of FY-26 is fair and reasonable. The estimated price is consistent with what the Federal Bureau of Prisons has been paying for during the last fiscal year.
8. FAR 6.303(b)(8): Description of the market survey conducted:
Market research was conducted by the Facilities Manager and to the extent commensurate with the urgency, established value, and complexity of the requirement. AVRRDD is the only landfill service within reasonable distance for the Coos County area, which is approximately 3 miles from FCI Berlin, 1 Success Loop Road, Berlin, NH, 03570.
9. FAR 6.303-3(b)(9): Other Facts Supporting the use of other than full and open competition:
The provision of landfill services is essential for the orderly operation of FCI Berlin.
10. FAR: 6.303-3(b)(10): List of Sources, if any, Expressed in Writing, an interest in the acquisition:
None.
11. FAR: 6.303-3(b)(11): Actions taken by the agency to remove or overcome barriers to competition:
None. AVRRDD is the only landfill services available to FCI Berlin area.

12. FAR 6.303-3(b)(12): Contracting Officer’s Certification:
I hereby certify that the above justification is accurate and complete to the best of my knowledge and belief.
