About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the purchase of Automatic Voltage Regulator (AVR) service and repairs for the U.S. Embassy in Tallinn, Estonia.

The U.S. Embassy requires a qualified service provider to inspect, service, and replace OEM/proprietary spare parts for the Embassy's AVR equipment, which is critical to providing stable, reliable power to sensitive life-safety, security, and IT systems. The estimated cost for this service is $35,000. The J&A cites FAR 6.302-1, as the spare parts are only available from the manufacturer, who is the only qualified service provider for this proprietary equipment. A market survey was not conducted as there are no other potential sources. The Contracting Officer has determined the anticipated cost is fair and reasonable. The contract is expected to be awarded to an unknown vendor by September 26, 2024.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION

OVERSEAS CONTRACTING ACTIVITIES

PR12853807 – Tallinn FAC – AVR Service and Repairs

1. I recommend that the U.S. Embassy in Tallinn, Estonia use other than full and open competition for the purchase of ‘8-year AVR servicing and repairs’. The estimated cost is $35,000.00.

2. Nature and/or description of the action being approved:

Approval and purchase of the critical AVR parts as listed in the quotation for

PR12853807.

3. A description of the supplies or services required to meet the agency’s needs:

The Embassy’s automatic voltage regulator (AVR) is sophisticated equipment that keeps the Embassy’s power stable for sensitive life-safety, security, and IT equipment..

The Embassy requires a qualified service provider to provide the service and spare parts to complete the detailed inspection, 8-year PM service, and replace OEM/proprietary spare parts within the AVR. These parts are required in order to provide stable reliable power to the downstream electrical equipment including sensitive computer systems, fire alarm panels, battery systems, physical security barriers, intrusion detection systems, and other important Embassy systems.

4. An identification of the statutory authority permitting other than full and open competition.

41 USC 253(c)(1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements;

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

This service is required to keep the Chancery’s automatic voltage regulator (AVR) in good operational condition. The spare parts are only available from the manufacturer and the manufacturer is the only qualified service provider for this proprietary equipment. These parts are required in order to provide stable reliable power to the downstream electrical equipment including sensitive computer systems, fire alarm panels, battery systems, physical security barriers, intrusion detection systems, and other important Embassy systems.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

Offers cannot be solicited from as many potential sources as is practicable because only the manufacturer has the qualified service credentials and required spare parts.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Price is fair and reasonable.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

Market survey was not conducted because the service and parts are only available from the manufacturer.

9. Any other facts supporting the use of other than full and open competition.

None

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

None

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

(1) The Embassy’s New Embassy Compound should be online by the next time this service is due. This will cause the existing equipment to be decommissioned. (2) OBO electrical engineers have determined that this piece of equipment is required to best protect sensitive systems requiring flawless voltage. We are unable to not have it at this point in time.
