About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for a lease renewal in Huntington, WV. The General Services Administration (GSA) seeks to exercise a five-year renewal option for 6,886 ABOA/8,195 rentable square feet of office space located at the River Tower Building for the Federal Bureau of Investigation (FBI), Veteran's Administration (VA), and Department of Homeland Security Federal Protective Service (DHS FPS). The current lease expires March 28, 2027, with the renewal period running from March 29, 2027, through March 28, 2032.
The total annual rent is $169,947.66 ($20.74 per rentable square foot), with a five-year aggregate contract value of $849,738.30. The justification for sole-source procurement is based on 41 U.S.C. 3304(a)(1), indicating only one responsible source can satisfy agency requirements. Market research conducted showed no alternative federal spaces available in the Huntington, WV area, and the incumbent location has been well-maintained since the lease commenced in 2017. The procurement strategy aims to provide the best value to taxpayers by avoiding high relocation and replication costs.

Justification for Other Than Full and Open Competition, Renewal Option
U.S. General Services Administration
GSA Region 3
Real Estate Acquisition Division
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
PROJECT NUMBER: 4WV0130
Agency Name: Federal Bureau of Investigation (FBI), Veteran’s Administration (VA) and Department of Homeland Security Federal Protective Service (DHS FPS)
1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.
The General Services Administration currently leases 6,886 ABOA/8,195 rentable square feet (RSF) of office and related space located at the River Tower Building, 1108 3rd Ave, Huntington, WV 25701-1577 under lease number GS-03P-LWV00041 for the Federal Bureau of Investigation (FBI), Veteran’s Administration (VA) and Department of Homeland Security Federal Protective Service (DHS FPS) . The current lease expires March 28, 2027. Approval is requested to exercise an existing five-year renewal with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The renewal option will be exercised in accordance with 41 U.S.C. 3304(a)(1) and the General Services Administration Acquisition Manual (GSAM), Renewal options, 570.401. The renewal period will be effective March 29, 2027 through March 28, 2032. Currently, FBI and VA have a need to stay in place and FPS has the potential to vacate, which is possible given termination rights.
2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
(INCLUDING ESTIMATED VALUE).
FBI, FPS and the VA began working with GSA on their continued occupancy of the River Tower office in 2024. The agencies have a continuing need of 6,886 ABOA/8,195 rentable square feet (RSF) in Huntington, WV. An existing, but unevaluated, 5-year renewal exists in the lease for the following rates:
Shell - $122,925.00 Annual ($15.00 per RSF) Operating - $47,022.66 Annual ($5.74 per RSF (rounded)) Total Annual Rent - $169,947.66 ($20.74 per RSF (rounded))
The aggregate contract value of all five years of the renewal is $849,738.30 rounded. The delineated area is defined as the city limits of Huntington, WV.
There is no vacant Federal Space available.
3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.
41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.402. In accordance with GSAR 570.402, use of the sole source authority is appropriate where it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.
