About this file
This document is a Justification for Other than Full and Open Competition (JOFOC) for a sole source acquisition by the Department of State Office of Acquisition Management. The agency requires the urgent acquisition of laboratory equipment including PCR systems, supplies, delivery, and installation in Kazakhstan to support COVID-19 emergency relief efforts by the Centers for Disease Control and Prevention and the U.S. Embassy in Nur-Sultan. The estimated cost is $317,879. Due to pandemic-related restrictions, procuring these items from a local vendor with established supply channels can meet the delivery and installation requirements within a reasonable timeframe. The JOFOC identifies Zalma Ltd. as the only vendor that complies with payment terms, specifications, and delivery deadlines. The contracting officer determined the anticipated $317,879 cost to be fair and reasonable.

SOLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS
FAR Part 13.501 (a)(1)(ii)
1. Identification of the agency and the contracting activity.
In accordance with Federal Acquisition Regulation (FAR) 13.501(a)(1) and 41 U.S.C. 1903, the Office of Acquisition Management proposes to award a purchase of laboratory equipment and supplies on the basis of other than full and open competition under the
Simplified Procedures for Certain Commercial Items. This acquisition is in support of
COVID-19 emergency relief effort by the Centers for Disease Control and Prevention
(CDC) and the U.S. Embassy Nur-Sultan, Kazakhstan. The estimated cost is $317,879.00.
2. Nature and/or description of the action being approved.
Purchase order for laboratory equipment and supplies.
3. A description of the supplies or services required to meet the agency’s needs.
Acquisition of supply, delivery and installation of laboratory equipment (PCR) as well as laboratory supplies in an effort to identify and contain the extend of the spread of the
COVID-19 virus in Kazakhstan.
4. An identification of the statutory authority permitting other than full and open competition.
This acquisition is conducted under the authority of 41 U.S.C. 3304, as implemented by FAR
13.05 and substantiated by the following:
FAR 13.501(a)(1)(ii) – Unusual and compelling urgency.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).
Due to restrictions in movement caused by the COVID-19 pandemic, the flow of goods in and out of the country is limited. Therefore, we looked at procuring services from local vendors who have established procurement channels and would be able to quickly supply and deliver the required items. Zalma Ltd. is the only vendor in the region who can comply with the USG terms of payment, meet the delivery and installation requirements, and supply the required real-time PCR systems within reasonable time.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under
FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).
This is an urgent and compelling requirement so an advance notice will not be synopsized
(FAR 5.202 (a)(2)). Four vendors were conducted for a price quote. This JOFOC will be posted within 30 days of award.
7. A determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable.
Based on market research, the price is considered both fair and reasonable.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
Market research was conducted by CDC Kazakhstan by reviewing local resources. Four vendors who sell laboratory supplies and equipment in the Kazakhstan market were contacted. Of the contacted companies, Zalma Ltd. is the only vendor who is able to comply with the USG terms of payment, meet the delivery and installation requirements, and supply the required real-time PCR systems within reasonable time.
9. Any other facts supporting the use of other than full and open competition.
N/A.
10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.
None.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
N/A.
