JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER $10,0000 ($2,000/$2,500 for Construction/Services) AND
UP TO $250,000
(See FAR 13.106-1)
Date: August 3, 2021 PR Number: 0040525886
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
The National Park Service (NPS), Channel Islands National Park, has a requirement for on-call commercial vessel charter service to provide transportation of multi-agency wildland fire crews and other incident personnel and freight as needed for initial wildland fire attack and ongoing response and other All Risk incidents including search and rescue operations and other emergency operations or evacuations, as needed per incident. Transportation shall be from the mainland (Ventura Harbor located in Ventura, CA) to marine areas and remote islands within Channel Islands National Park; a range of 11 to 50 miles off the coast of Ventura, CA, where the minimum incident response time is two hours. An Indefinite Delivery/Indefinite Quantity (IDIQ) type contract is contemplated to be effective for a period not to exceed five years (one base year and four option years). The anticipated cost over the total five-year time period is , with the understanding that the annual service will vary based on number of incidents, level of response required, and duration of the incident.
2. Sole Source Justification rationale (Check one and explain below):
X_____ Only one responsible source.
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain: Channel Islands National Park is logistically complex in nature. The park is comprised of 250,000 acres, half of which is marine (open Pacific Ocean) and the land area consists of five remote islands (Anacapa, Santa Cruz, Santa Rosa, San Miguel, and Santa Barbara), ranging a distance of 11 to 60 miles off the coast of Ventura, CA. Islands are isolated in nature, no community services exist, utilities are off-grid systems owned and operated by the NPS, and the only residents on the island are NPS Staff, as well as staff that reside on the portion of Santa Cruz Island owned by The Nature Conservancy (TNC), and US Navy staff stationed at an area that is leased from the TNC.
The park’s greatest threat is fire. A fire has very high potential to rapidly sweep across an island, decimating facilities, Native American archeological sites, endemic species (plants and wildlife), and human lives. On-call charter transportation is critical to deliver multi-agency fire crews responding to fires. Initial response and attack are critical as fire jumper response time is approximately four (4) hours, and fire trucks are transported by barge; neither having the ability to arrive on scene in short order, making the transportation of wildland fire crews that much more critical in this logistically complex park. Charter service is required to provide transportation of multi-agency wildland fire crews for initial attack and ongoing response, and to support other All Risk incidents as needed. Minimum response time is two hours.
Regularly scheduled public transportation or ferry service to the islands does not exist. The park’s concessioner, Island Packers (IPCO), located at 1691 Spinnaker Drive, Suite 105B, Ventura, CA 93001, is the only operator authorized to transport visiting public to park islands.
IPCO’s operating schedule varies by location, minimum passenger capacity, and season. IPCO has more than 50 years of operating experience within the park, including operating in the open ocean in all weather conditions, day and nighttime operations, landing vessels at park facilities (different at each island), associated crane operations and cargo handling, as well as live-boating passenger transfers. Due to the nature of sea conditions, vessels do not tie up to piers or wharfs in this park; passenger transfers are made while the boat is actively operating to provide a stable platform to conduct safe passenger transfer from the boat to ladder on docks/piers. IPCO captains have impressive and critical cumulative maritime experience operating within the park, which extends to their safety record. Their vessels are specifically designed for passenger and cargo transport, both in terms of seating, overall capacity, cargo space and related outfitting of the vessel. Due to the reasons outlined above, IPCO has been determined to be the only responsible source who can provide transportation service for fire crews and other staff responding to incidents from the mainland to marine areas and remote islands within Channel Islands National Park.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
This is a commercially available service; however, the park’s concessioner, Island Packers (IPCO), is the only operator authorized to transport visiting public to park islands.
Captains must hold current, appropriate U.S. Coast Guard license for the mission requirements;
have appropriate level of experience navigating the waters, anchorages, and landing wharf/dock/pier facilities at park islands within Channel Islands National Park. The emphasis is safe vessel operations, passenger safety, navigation, skiffing (if needed), and landing operations within the park in all weather and sea conditions, during the day as well as at night.
Vessels must have current U.S. Coast Guard inspection certificate, general liability and vessel/marine liability insurance; and be rated for carrying 100-149 passengers. The Contractor must staff the vessel with a minimum of one Captain and appropriate crew for the size of the vessel and mission.

4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
