About this file
This Justification for Non-Competitive Procurement (JNCP) document is for the Naval Information Warfare Center - Pacific, seeking to acquire specialized stormwater sampling and processing services from Stantec for the Puget Sound Naval Shipyard and Intermediate Maintenance Facility. The services involve collecting stormwater samples from multiple non-dry dock stormwater (NDDSW) outfalls during the 2025-2026 storm season to support refinements to sediment characterization and discharge modeling, with the goal of achieving regulatory compliance under the National Pollutant Discharge and Elimination System (NPDES) permit.
Stantec was selected as the sole source contractor due to their extensive two-decade experience with stormwater autosampler systems at the Bremerton Naval Complex, including specialized expertise in equipment setup, maintenance, and rapid response to storm events. Market research through internet searches did not identify alternative contractors capable of performing these services. The contract aims to demonstrate the effectiveness of NIWC Pacific's novel monitoring approach for differentiating legacy contaminants in sediments, with Stantec providing stormwater sample collection, processing, and reporting to support regulatory approval from EPA Region 10 and Washington Department of Ecology.

JUSTIFICATION FOR NON-COMPETITIVE PROCUREMENT (JNCP)
FOR ACTIONS < SIMPLIFIED ACQUISITION THRESHOLD (SAT)
JNCP#: JNCP-3582
PR/Solicitation Number: 1301271609
1) Agency, Contracting Activity and Purpose: Naval Information Warfare Center - Pacific, Justification for
Other than Full and Open Competition.
2) Description of the Supply or Service being procured, its intended use and anticipated/estimated value
a. These services are to support refinements to the stormwater suspended sediment characterization and discharge sediment deposition modeling NIWC Pacific has developed for Puget Sound Naval Shipyard and
Intermediate Maintenance Facility (PSNS & IMF). Under the new National Pollutant Discharge and
Elimination System (NPDES) permit, PSNS & IMF will be required to monitor stormwater discharges throughout the Bremerton Naval Complex (BNC) for potential impacts to sediments. Resuspension of sediments from shipyard operations (propeller wash, dry dock flooding/de-flooding, etc.) results in the release of legacy contaminants. Conventional monitoring approaches (e.g., grab sampling, sediment traps, and catch basin monitoring) cannot be used to differentiate legacy contaminants in sediments from stormwater-sourced contaminants. NIWC Pacific has developed a novel monitoring approach that can predict impacts to sediments from stormwater discharges. More discharge data are required from multiple
PSNS & IMF non-dry dock stormwater (NDDSW) outfalls to demonstrate the effectiveness of the approach and achieve regulatory approval from EPA Region 10 and Washington Department of Ecology, thereby helping ensure that PSNS & IMF achieves permit compliance. Collection of stormwater samples during the 2025-2026 storm season is an essential first step in demonstrating modeling effectiveness.
This acquisition is for services supporting the modeling of sediment deposition at multiple NDDSW outfall locations within the BNC. The contractor shall conduct stormwater collection and processing, and reporting.
b. The purpose of the services are to conduct stormwater collection and processing at locations within the
Bremerton Naval Complex (BNC). Stormwater autosamplers shall be programmed in advance of a forecasted rain event. Samples shall be collected and processed after the rain event and shipped to NIWC
Pacific for suspended sediment characterization and contaminant analysis. A summary report for each sampling event shall be delivered to the technical POC.
c.
3) Possible Authority for Non-Competitive Procurement
Sole/Limited Source Procurement ((Sole Source: Only one source exists with no known distributors of the required product or service. Only One Responsible/Capable Source IAW either FAR 8.405-6(a), FAR 13.106-
1(b) or FAR 16.505(b)(2)).
4) Reason for Non-Competitive Procurement
2 Template March 2019
Unique or highly specialized requirement/Only one source reasonable available
5) Provide rationale and justification regarding the above selection.
The use of Stantec for the services provided under this contract is requested due to the complexity of the stormwater autosampler systems installed at the Bremerton Naval Complex (BNC). These systems require experienced operators that understand proper set-up and running of the equipment, with experience performing routine maintenance, trouble-shooting problems and conducting repairs in the field. Stantec employees have over two decades of experience developing, installing, and servicing stormwater related equipment within the BNC – including the stormwater autosamplers. Through this duration of experience, the use of their services provides greater likelihood of successful sampling efforts. This avoids cost overruns and time delays related to repeating sampling events due to lack of knowledge and/or experience. The timing of stormwater collection is dependent on the rain event and tidal schedule. Stantec is located in Bremerton. Their field team can respond quickly and effectively to a developing storm and can execute the work under constrained timelines in adverse weather conditions with 24-hr availability.
Stantec has specialty equipment and the personnel with the qualifications/certifications to perform the work under the Navy’s requested parameters, all within the targeted period of performance. Additionally, Stantec has specialty experience with performance testing, monitoring, reporting and certification of stormwater treatment equipment under research and development, along with permitting and agency approval processes.
6) Describe the Market Research conducted.
Market research was performed through internet searches and evaluating prior shipyard reports. Google search on July 2, 2023 for, “stormwater BMP testing and evaluation contractor Puget Sound Naval
Shipyard” did not provide any additional contractors capable of performing the services requested.
7) Any other information of facts supporting the justification to limit competition not described elsewhere on this form (i.e. international agreement).
NA
8) Provide a statement of actions that will be taken to remove or overcome any barriers to competition prior to any future procurements for this Supply or Service.
To help overcome potential future barriers to competition, NIWC staff shall stay current on stormwater research, literature, and reports (including trade publications), which may outline work being done by contractors in the Puget Sound region. Attendance at stormwater-related conferences and engaging with other subject matter experts may also result in finding contracts with specific capabilities
