Feedback

5. Reason for Authority Cited: (FAR 6.303-2(b)(5)) Feedback Limited competition exist within the market for deployable antenna systems and requiring activity has express no preference in brand. In order to maximize competition while meeting the specification of this requirement, FAR 6.302-1(c)(2) and DFARS 206.302-1(c)(2) was implemented to establish brand-name or equal characteristics.

6. Efforts/Actions to Increase Competition: (FAR 6.303-2(b)(6) & (11)) Feedback Pre-solicitation notice will not be publicized in accordance with FAR 5.202(a)(13). However, a combined solicitation/synopsis will be posted to the GPE and will be competed under full and open procedures due to sparse competition within the market of deployable antenna systems.

7. Market Research: (FAR 6.303-2(b)(8)) Feedback Mandatory sources of supply, recommended sources of supply, and historical requirement posted to the GPE were surveyed with little to no results. Research of the commercial market was also surveyed which revealed the limited competition that exist for such a product. As a result, this requirement will be posted on the GPE under full and open procedures to maximize the amount of competition.

8. Other Authorities/Factors: (FAR 6.303-2(b)(9)) Reset Section Feedback

10 U.S.C 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1

9. Interested Sources: (FAR 6.303-2(b)(10)) Feedback Ham Radio Outlet (an authorized dealer for SuperAntenna) will be notified of RFQ posting to GPE.

Section5Text: (Describe how this action requires the use of the authority cited. If applicable, identify the proposed or potential contractor(s), and include a discussion of the proposed contractors’ unique qualifications for fulfilling the contract requirements. Note, only the one authority cited above may be addressed here, if more than one authority applies, cite and discuss the basis for use of them in Section 8, Other Facts.)

(NOTE: Agencies shall request offers from as many potential sources as is practicable under the circumstances, otherwise FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, must be cited and justified in Section 8, Other Facts.)

(For guidance, the three authorities used most often are cited in the following general order of precedence: (1) FAR 6.302-6 - National Security; (2) FAR 6.302-2 - Unusual and Compelling Urgency; and (3) FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. For example, if all three were to apply to a given procurement, FAR 6.302-6 - National Security would be cited here and the remaining two would be cited in order or precedence in Section 8, Other Facts.)

Section5Text: Market research reveled only one company/veterinarian hospital that was capable of performing this surgery and SAM registered. The SAM website was searched using the veterinarian services NACIS code of 541940. The search was limited by location to include states within driving range such as MD, VA, NC, and SC. After calling all SAM registered companies/veterinarians in these states and with this NACIS code only one was capable of performing this surgery. MPC Lady is unable to train and exercise until this training is complete. If we delay this procedure we run the risk of losing a top performing canine used for MARSOC Operations.

Section5Text: (a) Address why the proposed acquisition MUST be accomplished through a sole source solution, and why the authority in paragraph 4 applies. Provide a well-reasoned, detailed discussion of the rationale that will make it crystal clear to someone who has never heard of your organization or your requirement to substantiate why full and open competition cannot be used for this procurement. If applicable, identify the proposed or potential contractor(s) and include a discussion of the proposed contractor's unique qualifications for fulfilling the contract requirements.

•Describe how this action requires the use of the authority cited.
•Describe the circumstances and considerations that result in the determination to utilize a sole source Contractor and discuss the unique qualifications of the proposed Contractor to provide the required supply or service.
•Discuss why no other Contractor has or can be made to have the essential qualifications to meet the government’s requirements or specified delivery date.
•If brand name, describe in detail why a particular brand name product or feature of a product peculiar to one manufacturer must be used and describe why another brand name cannot meet or cannot be modified to meet the requirement.
•Explain why technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition have not been developed or are not available. Describe actions taken or planned to remedy this situation.
•If applicable, include an estimate of the cost to the Government that would be duplicated and not recouped through competition (can include actual or estimated set-up costs, transition costs, etc.), how the estimate was derived, and whether the original contract was competitively awarded. NOTE: The purpose for detailing duplicative costs is to provide a traceable basis for drawing the conclusion that the cost is so high that it would not be recouped through competition.

If urgency is the determined basis:

•Factually establish the urgent need. What were the circumstances leading to the emergency?
•Provide the required performance/delivery schedule, when the requirement was first known and address the lead-time involved; i.e. what is the time difference between using this authority as opposed sole source.
•Explain the serious injury to the Government which would result if not permitted to limit to a sole source.
•Address why other Contractors are unable to meet the Government’s requirements in a timely manner.
•Address any other considerations
Section5_6_302-1: Limited competition exist within the market for deployable antenna systems and requiring activity has express no preference in brand. In order to maximize competition while meeting the specification of this requirement, FAR 6.302-1(c)(2) and DFARS 206.302-1(c)(2) was implemented to establish brand-name or equal characteristics.
Section5_6_302-1Bridge: (Describe how this action requires the use of the authority cited.

(If the authority FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, is cited for a follow-on acquisition, include the estimate of the cost to the Government that would be duplicated and how the estimate was derived. NOTE: The inability of more than one contractor to meet the required delivery schedule would be justified under this authority. NOTE: If the J&A is for a bridge action, explain the rationale for issuing a bridge action (e.g. protest, inadequate planning, emerging technology, etc…), and the rationale for the length of the bridge action.)

(If the authority FAR 6.302-2, Unusual and Compelling Urgency, is cited, include the required delivery schedule and lead-time involved as well as the discussion of the serious injury to the Government, e.g., loss of life, mission failure, etc., which would result if award of a contract is delayed. NOTE: USSOCOM is required to request offers from as many potential sources as is practicable under the circumstances, otherwise FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, must be cited and justified in Section 8, Other Facts.)

(If the authority FAR 6.302-6, National Security, is cited, outline how disclosure of the Government’s needs would compromise the national security; the explanation should result in the J&A document being classified. When FAR 6.302-6, National Security, is cited, requiring activities should address program protection requirements as it relates to the Acquisition Strategy; relationship with the vendor, Procurement Vehicle (to include logistics tail); and Finance (payments/systems used, etc.). At a minimum, address the following elements related to the aforementioned areas:

What needs to be protected, Why it needs to be protected, At what level, and How will the information be protected)

Section6Text: Pre-solicitation notice will not be publicized in accordance with FAR 5.202(a)(13). However, a combined solicitation/synopsis will be posted to the GPE and will be competed under full and open procedures due to sparse competition within the market of deployable antenna systems.
Section6Text: (Describe the extent and the results of the market research (FAR Part 10) conducted to identify qualified sources. Research must have been conducted within the past 6 months and be available in written form within the official contract file. The Desktop Contracting Guide template, Market Research Report is an excellent tool.)

(Note: Make affirmative statement that the Technical Industrial Liaison Office (TILO) and Office of Small Business Programs (OSBP) databases were reviewed as a part of this market research. State the results of this review in the market research narrative.)

(Note: The Use of a chart to depict salient requirements and the ability or inability of prospective offerors to meet these requirements is a useful tool in encapsulating the results of the market research when combined with a narrative explanation.)

Section6Text: During market research we discovered at least two other companies capable of performing this procedure however they were not SAM registered. I recommended to these veterinarian offices they register their office in SAM to be considered for future Government Contracts.
Section6Text: A presolicitation notice was or will be publicized as required by FAR 5.2. If a notice will not be or was not publicized, the exception cited under FAR 5.202(a)(1) through (13) was:

(In addition to completing the information above, state the acquisition history. Describe efforts made to ensure that offers are solicited from as many potential sources as is practicable. Also include efforts to procure data rights to ensure future procurements are competitive, or explain why data rights cannot or should not be procured, i.e., excessive costs quoted by the prospective contractor.)

(Note: IAW DFARS 206.304(a)(4)(S-70), for non-competitive follow-on acquisitions previously awarded on a non-competitive basis citing the authority at FAR 6.302-1, follow the procedures at DFARS PGI 206.304(a)(S-70)).

(Include any actions to remove or overcome barriers to competition before any subsequent acquisition takes place.
