FOR OFFICIAL USE ONLY

FOR OFFICIAL USE ONLY – J&A No. 20-1919

United States Special Operations Command (USSOCOM)

Justification and Approval (J&A)

03 November 2020

FOR OFFICIAL USE ONLY – J&A No. 20-1919

Justification and Approval (J&A) for Other Than Full and Open Competition

-Authority: (10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1)

Project/Program Name: Tactical Combat Casualty Care (TCCC) Casualty Evacuation (CASEVAC) Sets

Component/PEO/Other: PEO-SOF Warrior

Estimated Contract Ceiling: $6.4M

Type J&A: (Individual or Class )

J&A No.

20- 1919

1. Agency and Contracting Activity: (FAR 6.303-2(b)(1))

Program Office:

Program Manager - SOF Survival, Support, & Equipment Systems (PM-SOF SSES) US Army CCDC-SC 10 General Greene Ave Natick, MA 01760

Contracting Office:

United States Special Operations Command (USSOCOM) Special Operations Forces Acquisition, Technology, and Logistics (SOF AT&L-KR) 7701 Tampa Point Blvd MacDill AFB, FL 33621

2. Description of Action: (FAR 6.303-2(b)(2))

Approval of this requested action will result in a sole-source award of the TCCC CASEVAC bridge contract effort to Tribalco, LLC.. They are the incumbent to the current TCCC CASEVAC Contract (H92222-10-D-0023), of which the period of performance (PoP) will expire on 31 October, 2020. This sole source award for a bridge contract is a parallel effort with the General Service Administration (GSA) full and open competition for the next USSOCOM CASEVAC Set Prime Vendor. Due to delays associated with GSA’s full and open competition as well as the impact of the COVID-19 Pandemic, continued acquisition of these mission-critical kits will be unavailable at the conclusion of the current contract. By awarding a bridge contract, USSOCOM will be able to continue support of end user requirements for this lifesaving capability as the ongoing re-compete effort continues in parallel. Ultimately, this is a risk mitigation strategy to avoid an unacceptable break in service and to continue support of the warfighter. The approval of the J&A would authorize the sole-source award to Tribalco LLC, the only entity to have fully supported the current contract and the only supplier of commercially available kits, modules, sub-assemblies, individual replacement parts, and training that meets USSOCOM’s operationally-validated end user requirements. Given the remaining

FOR OFFICIAL USE ONLY – J&A No. 20-1919 lifespan of the current contract PoP, coupled with the parallel GSA re-compete effort, establishing a bridge is the most cost efficient and effective course of action to ensure the USSOCOM end user community does not face a break in supplying critical lifesaving requirements. Procurement and O&M funds will be used to fund each individual delivery order when issued.

3. Description of Supplies/Services: (FAR 6.303-2(b)(3))

Procurement of TCCC CASEVAC individual component items and sub-assemblies is required to procure urgently required CASEVAC Set Transportation Kits and sustain the CASEVAC sets currently fielded as well as those planned for fielding. The TCCC CASEVAC Set is comprised of 4 Kits and within each kit are 13 Modules, which includes 965 unique items. This includes a wide variety of casualty evacuation equipment that is uniquely packaged and configured to provide the capability to access, extract, extricate, recover, treat, and sustain wounded soldiers from point of wounding until transfer to a definitive care facility. Additionally, New Equipment Training (NET) is required to provide the end-user with the capability to safely employ the equipment in an operational environment.

4. Authority Cited: (FAR 6.303-2(b)(4))

10 U.S.C 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1.

5. Reason for Authority Cited: (FAR 6.303-2(b)(5)) In accordance with FAR 6.302-1(a)(2)(ii), "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (B) Unacceptable delays in fulfilling the agency’s requirements.” As stated in the market research report, contract vehicles exist that can support portions of the current requirement capability. Although these alternative vehicles exist, utilizing these alternative methods would increase cost and cause undue delays impacting delivery of the CASEVAC kits to the operator. From past experience on similar efforts it’s estimated it would take approximately four to six months to qualify the kits and an additional six months in logistics to update all configuration management. Additionally, the requirement for NET training is a vital component to this program and the alternative sources cannot support this component of the requirement. Given the timing and criticality of this need, it is not feasible to utilize these alternative acquisition vehicles to bridge the anticipated gap between conclusion of the current contract and GSA’s anticipated award.

Pursuant to this J&A, the TCCC CASEVAC Systems procured under this contract are highly specialized medical equipment configured and packaged into a specific CASEVAC Set configuration, that has been operationally tested and evaluated to meet the approved USSOCOM technical, and operational mission requirements. The current vendor, Tribalco, LLC., provides the only tested and certified, uniquely-packaged and configured sub-assemblies within the CASEVAC Set which maintains critical configuration control of these life saving devices. Tribalco’s unique configurations, packaging, and sub-

FOR OFFICIAL USE ONLY – J&A No. 20-1919 assemblies were awarded as a result of a full and open competition among competing vendors as the best value approach to meeting this complex and lifesaving set of equipment.

While the original contract is set to expire on 31 October 2020, a short-term bridge contract is required to ensure the end user community has continued access to this lifesaving capability while the delayed re-compete effort is executed in parallel.

The TCCC CASEVAC Set required a which is applicable only to the approved set configuration, prior to fielding to the USSOCOM Components. Of the 965 unique items, 691 of these items consist of Tribalco-unique sub-assemblies and configurations which are not commercially available from any other source, at this time. While the “non-Tribalco-unique” items remaining within the set are commercially available from multiple sources, they are critical lifesaving monitors and other equipment that must interact and be interoperable with the other components within the set and remain in the tactical packaging not commercially available for all components. Substitution of these items with incompatible products could directly result in further trauma or loss of life.

While many of the items within the CASEVAC Set are commercial, the configuration of the Set is technically complex in nature, utilizing the latest technology, lightest weight, most compact design, and integration of multiple capabilities with highest durability and reliability. The Set’s dynamic design allows all SOF operational personnel to easily identify and utilize the equipment to facilitate the rescue/recovery, transport, medical treatment and sustainment of casualties. Given the short lifespan of the proposed bridge effort, it is logical to maintain the current, approved configuration while the parallel re-compete effort evaluates proposed alternatives to the current design, and will ultimately award the best-value, fully-interoperable, configuration for continued support to the warfighter. In addition, failure to approve this J&A will result in reduced medical CASEVAC capability for deployed warfighters, thereby jeopardizing successful mission accomplishment during the inevitable break in service that is due to previously mentioned delays encountered by the GSA re-compete effort. This is not purely an administrative concern - USSCOM’s missions are conducted in hostile environments, any delays to, or lack of these items could result in loss of life.

6. Efforts/Actions to Increase Competition: (FAR 6.303-2(b)(6))

A notice was or was not publicized as required by FAR 5.2.

Acquisition History: The original contract for TCCC CASEVAC Sets was competitively awarded to Tribalco, LLC, on 24 October 2010. A follow-on full and open contract award is currently being executed by GSA. To date, the GSA contracting office team posted a sources sought on FBO.gov on 28 October 2019, a pre-solicitation on beta.SAM.gov on 7 May 2020 with multiple updates to the pre-solicitation occurring between May and July 2020 and held a virtual industry day on 9 July 2020. The GSA contract team submitted

FOR OFFICIAL USE ONLY – J&A No. 20-1919 the final draft RFP documentation for official review and approval and the team is expecting to post the official RFP in the 4th Quarter of CY2020 with anticipated award in the 1st Quarter of CY2021. The GSA/PMO team’s schedule anticipates a timeline that may cause a gap between the conclusion of SOCOM’s current contract and GSA’s expected new contract award. Establishing a bridge contract for the TCCC CASEVAC Set will allow for the continued procurement towards achieving Full Operational Capability, (FOC) while maintaining life cycle sustainment of currently fielded systems, and allowing USSOCOM to fully support the CASEVAC Sets during the execution of the aforementioned GSA re-compete effort.

7. Market Research: (FAR 6.303-2(b)(8))

The USSOCOM TCCC PMO team conducted extensive market research which is captured in the Market Research Report (MRR) in support of the ongoing GSA re-compete effort under Task Order ID: ID04200024. In addition, the PMO team has completed ongoing market research with an MRR updated for this sole source award.
