JUSTIFICATION FOR A SOLE SOURCE AWARD

FOR CERTAIN COMMERCIAL ITEMS

1. Contracting Activity: Department of Veterans Affairs Office of Procurement, Acquisition, and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724

2. Description of Action: The proposed action is for a sole source Firm-Fixed-Price contract for maintenance service for previously purchased 3D systems, 3D printers and associated equipment at the Central Virginia Medical Center. Specifically, the Department of Veteran Affairs (VA) Office of Advanced Manufacturing (OAM) requires ProX SLS 6100 - 3D Elite Service Plan from 3D Systems, Inc. (hereafter referred to as 3D Systems), 333 Three D Systems Cir, Roch Hill, SC 29730.

3. Description of Supplies or Services: The VA OAM requires continued maintenance from 3D systems for hardware products currently in use at the Central Virginia VA Medical Center (CVVAMC). This requirement is necessary to provide continued of assistive technology, prosthetic components, and other items requested by clinicians tion and independence.

The equipment to be serviced includes two (2) ProX Selective Laser Sintering (SLS) 6100 3D printers (SN: 2007F407701 and 2007F405201) and one (1) Material Quality Control (MQC) System (SN: 200523434_12). The requested maintenance service plan will provide comprehensive coverage to ensure the operational readiness of the equipment and minimize downtime critical to patient care support operations.

The maintenance covers the following services:

One (1) preventative maintenance service visit per year (inclusive of parts required for event) Onsite labor support, including after-hours service Spare part replacement coverage (excluding consumables) System laser replacement coverage (includes subsystem) Service coverage for MQC and nitrogen generator Next business day response time Unlimited phone and remote technical support Printer software and firmware updates Next business day parts shipping (where available) Application remote support 3D Connect Service (where available)

The period of performance consists of one (1) 9-month base period with four (4) 12-month option periods. The total estimated value of this requirement is , inclusive of all options.

4. Statutory Authority: The statutory authority permitting other than full and open competition is 41 U.S.C. 1903 as implemented by the Federal Acquisition Regulation

5. Rationale Supporting Use of Authority Cited Above: The Central Virginia VA Health Care System (CVVAHCS) purchased the two (2) ProX SLS 6100 3D printers and its support machinery the MQC for approximately in 2021. The ProX SLS 6100 printers are powder bed fusion additive manufacturing machines designed to manufacture parts and prototypes rapidly out of various plastics. The mission of VA OAM is to provide benefits and services to Veterans of the United States by providing manufacturing services for the creating of assistive technology, prosthetic components, and other items requested by clinicians for their veteran patients. Veterans are a highly independent patient population; providing them with adaptive equipment that allows them to maintain their independence is crucial for their mental and physical health. The 3D printers allow biomedical engineers and clinicians to collaborate and create patient specific devices to help Veterans reach their health and life goals.

3D Systems is the exclusive manufacturer of the current VA owned ProX SLS 6100 printer and MQC equipment that requires maintenance and support at the CVVAMC.

The ProX SLS 6100 and MQC, along with their specifications and software, are proprietary to 3D Systems. Only technicians employed by 3D Systems have the authorization to maintain the equipment and software platform at the medical center.

3D Systems does not provide training to third-party service providers and may terminate a service agreement if parts or labor are purchased from a non-affiliated party. Therefore, choosing an alternative source for maintenance would require the complete replacement of the entire existing VA-owned equipment currently in use at the CVVAMC, due to the proprietary nature of 3D Systems products.

Utilizing any potential alternatives would require replacement of the existing VA owned hardware environment, as no alternative could provide replacement parts or support

Systems has made it clear in an email dated October 25, 2025, that only they can provide and install upgrades and firmware patches for their products. Replacing the equipment would involve purchasing and installing the equipment that could take at least one (1) year to install, two (2) months of operator training and learning curve which would cost up to an estimated $600,000.00, based on previous installations; and would also result in a stoppage or degradation in care for Veteran patients.

This acquisition is necessary to keep the VA owned equipment and system updated and compliant. Not upgrading poses a risk of performance issues or outages impacting adaptive devices for Veterans.

6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any proposed action will be synopsized on the Contracting Opportunities Page in accordance with FAR 5.201 and the ordering activity will make publicly available the justification along with the solicitation in accordance with FAR 13.501(a)(1)(iv). Any proposals that are received shall be evaluated.

7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed.

8. Market Research: The Government's technical experts conducted market research needs. Alternate products from Formlabs, 3D Logics, and Sinter IT were identified as potential alternatives, however they all would require replacement of the existing VA-owned hardware environment, as none of these alternatives could provide replacement hardware. 3D Systems have made it clear that only they can provide and install upgrades and firmware patches for their products via email on October 25, 2025. The ProX SLS 6100 3D Elite Service Plan is exclusively offered and available only through 3D Systems and not through their approved reseller(s). As such, no authorized reseller(s) or subcontractor(s) are permitted to provide this specific maintenance plan.

only 3D Systems, as the sole authorized provider of maintenance services, can provide the required maintenance for the ProX SLS 6100 3D Elite Service Plan. Additionally, on October 25, 2025, the 3D Systems Customer Success Manager confirmed via email that the required maintenance package is available only directly through 3D Systems (i.e., not through resellers). Therefore, no other vendors or resellers were identified in maintenance and service support

Fair and Reasonable Cost Determination

I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable in accordance with FAR 15.404-1(b)(2), via (ii) comparison of the proposed prices to historical prices paid, whether by the Government or other than the Government, for the same or similar items and (v) comparison of proposed prices with independent Government cost estimates.

I certify that this justification is accurate and complete to the best of my knowledge and belief. This contract action exceeds the simplified acquisition threshold, but does not exceed $900,000, therefore, the certification required by FAR 13.501(a)(2)(i) serves as
