Justification for Other Than Full and Open Competition

1. Agency and Contracting Activity: (FAR 6.303-2(b)(1))

2. Description of Action: (FAR 6.303-2(b)(2)) The purpose of this J&A is to provide authority to solicit, evaluate, and award one (1) new Firm-Fixed-Price (FFP) single award indefinite delivery indefinite quantity (IDIQ) for pre-deployment close quarters battle (CQB) training. The solicitation will result in one (1) IDIQ with one (1) twelve (12) month base year and four (4) twelve (12) month option years. The IDIQ is estimated at $

O&M (MFP-11) funds will be used to execute these requirements.

3. Description of Supplies/Services: (FAR 6.303-2(b)(3)) Special Tactics (ST) personnel from the 24 Special Operations Wing (24 SOW) require the most dynamic and realistic operational training scenarios possible to acquire, improve, and maintain advanced CQB skills. The contractor shall provide training and exercise scenarios that include classroom, operational, and field exercises using the latest equipment, tactics, techniques and procedures (TTP), simulations and models, and must have the appropriate security clearances. Operational exercises shall be tailored specifically to the ST specialist skills, based on real world combat missions. Training must comply with 720th Special Tactics Group (720 STG) training requirements to increase ST operators' proficiency in primary weapon systems and TTPs.

5. Reason for Authority Cited: (FAR 6.303-2(b)(5)) The authority cited is 10 U.S.C. 2304(c)(1), where full and open competition need not be provided when the services required by the agency are available from only one or a limited number of responsible sources, and no other type of services will satisfy agency requirements.

IAW the market research, Section 6 and Section 7, only eight (8) vendors were determined capable to fulfill the technical requirements for the IDIQ. The IDIQ will be competed between the limited number of sources, determined in the market research and presolicitation notices, to fulfill the requirements.

A presolicitation notice was publicized as required by FAR 5.2. All interested parties, from the Sources Sought and those identified by the end user, received the link to the presolicitation notice posted to BETA.SAM. All parties, both identified or not previously identified, are required to submit capability statements to 24 SOW/PK for review in order to receive the solicitation; if a party is determined to not meet the requirements, they will not receive the solicitation.

24 SOW will ensure that offers are solicited from as many potential sources as is practicable by continually conducting market research for potential sources for these types of highly specialized training services to satisfy community requirements, and vetting their capabilities against 24 SOW requirements. When feasible, future acquisitions will not be accomplished before the market research results have been thoroughly reviewed for other potential sources of the desired services. Research will consist of internet-based analysis to identify possible services that meet specific requirements associated with service capability gap. Additional sources will be identified and qualified by the 24 SOW contracting office, in conjunction with appropriate subject matter experts and when in the best interest of the USAF and the government. When alternative sources are known to exist, reasonable attempts will be made to vet their capabilities against 24 SOW requirements.

Because of sensitivity and safety considerations for ST, any award under this J&A will be accomplished as limited competition between known vendors which meet the established program technical constraints.

The use of vendors other than those currently determined capable would require the full requirement be posted on Federal Business Opportunities (BETA.SAM). This would advertise what we are training for, number of personnel, and the location of personnel during the training, thus exposing personnel to potential harm.

7. Market Research: (FAR 6.303-2(b)(8)) IAW FAR 10.001, market research was conducted for this requirement. Market research by the customer and contracting officer was completed using internet research, talking to Subject Matter Experts (SMEs), contacting companies that have been awarded similar contracts, and reviewing market research from historical contracts within the 24 SOW. Due to the reasons listed in Section 5 of the Justification and Approval, IAW FAR 6.302-1 and 10 U.S.C 2304(c)(1), only eight (8) vendors were determined capable to fulfill the security and technical requirements; all eight (8) vendors will be required to sign a NDA prior to receiving the solicitation. IAW 10 U.S.C 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1, it is in the government’s best interest to solicit and award a contract to the vendor whose offer represents the best value to the government.

Close Quarters Battle (CQB) Training - eight (8) total companies: Acrolect, Ascendancy Group, ATSCC, Check Defense, Crucible, Hager, Intelitrac, Resicum

IAW DFARS PGI 206.302-1(d), a sources sought notice was posted on 24 November 2020 to BETA.SAM for 14 days; the post closed on 8 December 2020. Ten (10) companies responded to the sources sought. Upon posting of the presolicitation notice, the originally identified vendors and those who expressed interest in the sources sought were directed to the link for the notices; eighteen (18) vendors expressed interest in the notices, and eleven (11) provided capability briefs. As stated in the notices, each vendor was required to submit a capability brief that identifies their capabilities for all sections required; vendors who did not submit all required aspects or did not meet a requirement will not be solicited to.

9. Interested Sources: (FAR 6.303-2(b)(10)) CQB Training - each vendor who submitted a capability brief was reviewed by the SMEs and 24 SOW/PK to determine if they met the requirements listed in the presolicitation notices. 24 SOW/PK also checked each companies registration in SAM to ensure that the company's registration was active and they were not barred from government work. Eight (8) vendors were determined capable to meet the instructor and facility requirements and did receive the solicitation; the interested companies were: ACROLECT, ASCENDANCY, ATSCC, CHECK, CRUCIBLE, HAGER, INTELITRAC AND RESICUM.

NOTICE 1

Prior to approval, J&As will be screened to identify proprietary data and information exempted from disclosure by 5 U.S.C. 552, Freedom of Information Act, so that the final J&A may be prepared for required posting to FedBizOpps IAW Section 844 of NDAA 2009 as implemented via DPAP Memo, Public Disclosure of Justification and Approval Documents for Noncompetitive Contracts, dated 13 February 2009. J&As shall be posted to FedBizOpps within 14 days unless 10 U.S.C 2304(c)(2), Unusual and Compelling Urgency is cited. In that particular case the J&A will be posted within 30 days.

11.
