About this file
This is a Justification and Approval (J&A) document for using other than competitive procedures to award a sole source lease renewal to Presidential Drive L.P. for office space located at 3000 Presidential Drive, Fairborn, OH 45424. The Air Force requires up to 50,000 SF of office space to continue housing operations that were consolidated from Las Vegas (30,000 SF) and Dayton (20,000 SF) locations in 2023-2024.
The current lease (USAF-AFMC-ZHTV-19-1-0156) expires in June 2025 and the Air Force seeks to award a follow-on lease for one base year plus nine option years. The space requirement includes the currently leased 45,288 SF plus an additional 9,785 SF. Market research determined no other suitable facilities are available at Wright-Patterson AFB or in the greater Dayton area that could meet requirements without substantial duplication of costs and mission delays. The J&A cites that moving to a new location would incur significant costs for tenant improvements and potentially impact small business innovation programs that rely on the facility's current location and capabilities. The document is signed by Robert E. Moriarty, Deputy Assistant Secretary of the Air Force (Installations) on February 6, 2025.

III. AUTHORITY FOR THE USE OF OTHER THAN COMPETITIVE PROCEDURES
10 U.S.C. § 2661(b) provides legal authority under which the Secretary of a military department may acquire a lease of a building or a facility to meet military department requirements. Since a lease of a building or facility is the acquisition of property (other than land) and will be paid
, competitive procedures pursuant to the Competition in Contracting Act of 1984. Pub. L. No. 980369, Division B, Title VII, §§ 2701-2753, 98 Stat. 1175 (18 July 1984) apply. When lease requirements are general administrative space, there are typically many properties and property owners that can meet such general lease requirements and are selected unacceptable delays in fulfilling the agency's needs; in this acquisition both (i) and (ii) above apply. SAF/IEI has and continues to reserve the right to approve all final terms and conditions of said lease and to make all determinations required by or in accordance with all Applicable Laws.
