JUSTIFICATION AND APPROVAL

J&A No. 25-30-2

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Department of the Navy, Naval Facilities Engineering Systems Command Southwest (NAVF AC SW), San Diego, California.

2. Description of Action Being Approved.

Request approval to use other than full and open competition to increase the maximum not-to-exceed value of the Geotechnical Engineering Services, 8(a) Set-Aside single award Architect and Engineering (A-E) basic Indefinite-Delivery Indefinite-Quantity (IDIQ) contract, N62473-22-D-1012 by $10,000,000 from $15,000,000 to $25,000,000. To date, the current remaining unused capacity is $ This capacity increase will accommodate award of future task orders and execution of modifications to existing and future task orders. Increased contract capacity is required to allow a continuation of critical services on existing task orders, and to maintain NA VF AC SW operations while the follow-on contract is being awarded. The IDIQ ordering period expires on 27 September 2027 and will remain unchanged.

3. Description of Supplies/Services.

Contract N62473-22-D-1012 provides for geotechnical engineering services at Government installations primarily in the NAVFAC SW Area of Responsibility (AOR) in California, Arizona, Nevada, Colorado, New Mexico and Utah. Contract services include, but are not limited to, Subsurface / Geotechnical Investigations, Geotechnical Reports, Geotechnical Analyses and Recommendations, Fault Rupture Hazard Investigations, Geologic Landslide Investigations, Geologic Reconnaissance, Geophysical Surveys, Geotechnical/Geologic Forensic Investigations, Construction Support and Testing, Environmental Investigations, Utility Investigations, Topographic Surveys/Maps and Hazardous Materials.

The contract was awarded under North American Industry Classification Systems (NAICS) Code 541330 with a task order range of$2,000 to $1,000,000. It was competed under an 8(a) Set Aside pursuant to 40 U.S.C. 1101, Selection of Architect and Engineers, as implemented by FAR 36.6.

Award was made to Del Mar Environmental & Construction Services, Inc. on 22 September 2022 for a base period of two (2) years and one (1) 3-year option period with a NTE value of $15,000,000.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is IO U.S.C. 3204(a)(l ), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source.

5. Rationale Justifying Use of Cited Statutory Authority.

NAVFAC SW requires additional contract capacity that exceeds the contract's remaining capacity of which includes future planned awards in the amount of$ (as of24 March

2025). Contract N62473-22-D-1012 is the only NAVFAC SW A-E IDIQ contract for geotechnical engineering services. Actual usage of this contract has consistently exceeded planned usage. In the

This delay in response by the SBA has delayed the procurement cif a follow-on contract until the J quarter of FY 2026. Current contract capacity is projected to be expended earlier than the follow-on award date, resulting in a gap in geotechnical engineering services. · - · ·

Co.nsidei'ing the importance of this IDIQ for NAVFACSouthwest design and construction programs, historical usage bf this contract; and the uncertainty of future delays in the follow-on procure,nent, it is critical that the capacity of this contract to be increased sufficiently to prevent a break in service until the follow-on contract is awarded.

It is critical to the NA VFAC SW mission to maintain an active Geotechnical Setvices contract, Geotechriical site investigations ate often required prior to aiw construction starting: therefore, a: gap in the ability to contract these services could result in multiple delays ofprim'ity projects throughout the NAVFAC SW AOR. Increased contract capacity will ensure continuity ofgeotechnical services, allowing for the planned award of new task orders and modifications, an� provide reserve capacity to accommodate u11foreseen work required under new and existing task orders.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
