About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition issued by the Federal Bureau of Investigation (FBI) for the acquisition of a CyberSecure IPS Cyber Sensor Controller.
The FBI is seeking to acquire 1 Cyber Sensor Controller from CyberSecure IPS, who is the sole manufacturer of the required item. The requirement is to provide the Cyber Sensor Controller at an estimated total cost not to exceed $____. The controller and associated components must be compatible with existing FBI infrastructure and security systems at the Redstone Arsenal campus. The FBI intends to post a Notice of Intent to Sole Source on SAM.gov, which will allow other vendors to demonstrate their ability to meet the FBI's requirements. Prior to award, the Contracting Officer will determine the proposed price is fair and reasonable. The FBI has determined that only CyberSecure IPS can meet the specific requirements due to existing security constraints and infrastructure on the Redstone campus.

FEDERAL BUREAU OF INVESTIGATION
FINANCE AND FACILITIES DIVISION | PROCUREMENT SECTION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN
FULL AND OPEN COMPETITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (1)
Requisition Number: 001437
Date: April 29, 2024
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Acquisition Administrative Unit (AAU), has prepared this justification for other than full and open competition for the CyberSecure IPS Cyber Sensor Controller on behalf of the Finance and Facility Division (FFD), Redstone Enterprise Services Unit (RESU).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The proposed action is to acquire a quantity of 1 (one) Cyber Sensor Controller as a one-time firm-fixed price contract. It is the intent that this will be awarded to CyberSecure IPS as they are the sole manufacturer of the Cyber Sensor Controller.
3. A description of the supplies or services required to meet the agency’s needs.
The requirement is to provide Cyber Sensor Controller at an estimated total cost of $____.
This includes IDS equipment, products, corresponding components, and licensing listed below. IDS standards and guidelines are directed by the FBI’s Technical Security Guide (TSG), National Institute of Standards and Technology (NIST) and the Committee on National Security Systems (CNSS). All items must be compatible with existing Cybersecure, Identiv, Bosch and Magnasphere core components. Compatible minor components by minor vendors include: Dayton, HID Global, Wikk, Assa Abloy, Securitron, Eaton, Diablo Controls, LifeSafety, Omron, medeco, EPCOS / TDK, Honeywell, Sentrol, Edwards Signaling, System Sensor, Larson Electronics, Optex, and Telguard.
The FBI will be building the Innovation Center, CUP2 and Kinetic Cyber Range on the North Campus of Redstone Arsenal. These new buildings will require an Intrusion Detection System and locks.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
• FAR 8.405-6(b) – An item peculiar to one manufacturer is required.
Each component and manufacturer added IDS list must be approved by Security Division’s Physical Security Unit before purchasing can be approved.
Replacement items can only be suggested when a component is at end of life. Replacement suggestions are not an automatic substitution. Replacement parts must be approved by FBI Security Division and the Redstone ET shop to confirm compatibility and capabilities before being substituted. The component list and brand names are crucial to maintain the IDS on the Redstone campus. Only the suggested sources can furnish the requirements, to the exclusion of other sources, because of the existing security requirements and the in-place infrastructure.
Technology within the IDS portfolio is advancing at a rapid pace. Technological advances, initiatives, and testing will require the addition of parts to this requirement over the life of the contract. These items will have met ET and Security requirements prior to the addition to the contract.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
A Notice of Intent (NOI) to Sole Source will be posted on the SAM.gov website for this requirement, which will publicize the FBI’s intent to issue an award to CyberSecure IPS. This announcement will also give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of their technical capabilities and cost information for consideration prior to an award being issued.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated dollar value of this award shall not exceed _____. Prior to issuing an award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3. The Contracting Officer will use price analysis to determine fair and reasonable price. The price quote(s) will be evaluated using Lowest Price Technically Acceptable
(LPTA).
8. A description of the market research conducted and the results.
Multiple avenues were researched for this requirement. Market research started with conversations with OTD regarding past BPA and IDIQs for IDS components and additional conversations with contracting to determine the best contract vehicle to be utilized in order to provide the best value to the government.
9. Any other facts supporting the use of other than full and open competition.
This requirement must seamlessly integrate with the existing platforms, with no additional training, infrastructure requirements, or personnel. The increase in devices also increases the need to expand the control center components and licensing. The IDS infrastructure is utilized by security components on the FBI campuses to monitor the FBI’s security posture 24 hours a day. The brand names listed in this document are essential to the Government’s requirements for IDS components on the Redstone campus.
10. A listing of any sources that expressed a written interest in the acquisition.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The actions of RESU to identify potential sources possessing the ability to satisfy this and similar requirements are ongoing. Over time, additional sources may become available and identifiable through market surveys, trade shows, collaboration with other Federal agencies, or other means. The ability to predict this possibility is difficult. Therefore, the barriers to competition they impose are impossible to avoid.
