About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition under FAR 13.501 to increase the ceiling of contract H9225721D0002 for flat monthly fee multifunctional device (copier/scanner/fax) support services for the Marine Forces Special Operations Command (MARFORSOC). The contract currently has three option years remaining, but usage is projected to exceed the current ceiling over the next three years. This J&A will modify the contract to raise the ceiling so that MARFORSOC can procure 12 additional multifunctional devices and maintenance support for both non-secure and secure networks, at an estimated cost of less than $51,000 over three years. The authority cited is 10 U.S.C. 3204(a)(1), as the additional requirement is a natural follow-on to the existing contract that should have accounted for future growth. Market research identified 13 GSA schedule holders, including 3 small businesses, that could potentially fulfill this requirement.

1. Agency and Contracting Activity: (FAR 13.501)

Marine Forces Special Operations Command (MARFORSOC)

G4-Contracting

Rifle Range Road, Bldg. 465 Bay 102

Sneads Ferry, NC 28460

2. Description of Action: (FAR 13.501)

This approval is to increase the ceiling of contract H9225721D0002 for flat monthly fee multifunctional device (copier/scanner/fax) support services to MARFORSOC. Although the contract has three option years remaining, current usage projected over the next three years will expend the current contract ceiling amount. This action will modify the contract to raise the ceiling so that MARFORSOC may procure additional multifunctional devices to meet requirements for new facilities and functional support requirements. The resultant contract action will be H9225721D0002-P00009.

3. Description of Supplies/Services: (FAR 13.501)

12 additional multifunctional devices and maintenance support employed on both non-secure internet protocol router (NIPR) and secure internet protocol router (SIPR) network. Cost is expected to be less than $51,000 over three years.

3 (REV JUNE 2023)

10 U.S.C. 3204(a)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a)(2)(iii)

The additional requirement for copiers is a natural follow on to H9225721D0002, which was awarded with erroneously awarded no additional ceiling for expansion as should have been expected as MARFORSOC was in the process of moving units from the west coast to the east coast and expanding military construction projects in the Camp Lejeune, North Carolina area. A significant purpose of indefinite delivery, indefinite quantity (IDIQ) contracts, such as H9225721D0002, is to account for this type of uncertainty. To procure the new requirement for copiers separately from H9225721D0002 would create substantial duplication of cost to the Government that is not expected to be recovered through competition for an effort of such a low dollar amount.

5. Reason for Authority Cited: (FAR 13.501)

A main purpose of IDIQ contracts is to allow for uncertainty of needed quantity and to order additional services as required within the ceiling. The Government erroneously did not account for future growth in IDIQ H9225721D0002 and thus must use this authority to provide for additional required services. Procuring these services in a separate purchase order would require the time to conduct a new solicitation and separate contract administration of the resultant contract as well as vetting of a new contractor for entrance to MARFORSOC secure compounds. This duplication of these administrative efforts for a relatively small purchase is considered excessive and the resultant cost would not be recovered in soliciting the requirement separately.

6. Efforts/Actions to Increase Competition: (FAR 13.501)

This action is required mainly to correct an error in the improper use of an IDIQ contract. The increase is approximately 3% of the total contract and should have been included in the initial award. Prospective offerors would normally expect growth in requirements or changes to contracts for multifunctional device contracts.

H9225721D0002 was solicited for full and open competition to small businesses, and it is expected this requirement will be solicited full and open at the end of the contract period of performance.

7. Market Research: (FAR 13.501)

A search of GSA e-library discovered 13 multiple award schedule holders under Category 333316F Flat Rate Monthly Fee for Copiers. Three of these contractors are small businesses.

Since the action is less than the Simplified Acquisition Threshold, a request for information per DFARS PGI 206.302-1(d) was not issued as FAR part 6 and DFARS 206 are not applicable to this action.
