About this file

This is a Justification and Approval (J&A) document for use of other than full and open competition (JA-26-0006) issued by the Naval Facilities Engineering and Expeditionary Warfare Center (NAVFAC EXWC), Port Hueneme, California. The document seeks approval to extend Contract N39430-21-D-2302 with Tank Industry Consultants, Inc. for Water Tank Facilities Inspection (WTI) and Assessment services by six months, from February 10, 2026 to August 10, 2026. The contract is a Firm Fixed Price Indefinite Delivery, Indefinite Quantity (IDIQ) single award small business set-aside that was originally awarded on February 10, 2021. The services provide water tank inspection, structural condition assessment, and engineering and design support for Sustainment, Restoration and Modernization (SRM) projects at Department of Defense water tank facilities throughout CONUS, with specific projects including inspections at Pax River, Indian Head, Southeast Region, and Mid-Atlantic Region locations.

The extension is justified under 10 U.S.C. 3204(a)(2) for Unusual and Compelling Urgency, citing an anticipated six-month gap between the current contract's expiration and the award of a follow-on contract in August 2026, combined with NAVFAC EXWC's lack of in-house resources and specialized expertise to perform the required work. The J&A notes that timely completion is critical to avoid severe impact to mission-critical functions and fleet warfighter readiness. The current capacity is deemed sufficient to support FY26 execution requirements. A competitive follow-on contract is in process with three firms selected for interviews, and the J&A will be posted on SAM.gov within fourteen days after award of the contract modification in accordance with FAR 6.305.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The requiring activity is Naval Facilities Engineering and Expeditionary Warfare Center (NAVFAC EXWC), Port Hueneme, CA. The contracting activity is Naval Facilities Engineering and Expeditionary Warfare Center (NAVFAC EXWC) Acquisition Operations Team (CON74).

2. Description of the Action Being Approved.

This Justification and Approval (J&A) seeks approval to extend the period of performance for Contract N39430-21-D-2302 Water Tank Facilities Inspection (WTI) and Assessment, CONUS Architect-Engineer (A-E) Services awarded to Tank Industry Consultants, Inc. by 6 months from 10 February 2026 to 10 August 2026.

In accordance with the Navy Marine Corps Acquisition Regulation Supplement (NMCARS) 5206.303-1(S90), an approved Request for Bridge Contract (2 February 2026) is provided with this J&A.

3. Description of Supplies/Services.

The WTI and Assessment is a Firm Fixed Price (FFP) A-E services Indefinite Delivery, Indefinite Quantity (IDIQ) contract which was awarded as a single award and small business set-aside to Tank Industry Consultants, Inc. on 10 February 2021.

The purpose of this requirement is to provide support for the Navy’s need to acquire services for water tank inspection, structural condition assessment, and engineering and design services in support of Sustainment, Restoration and Modernization (SRM) projects at DoD water tank facilities at various locations within CONUS.

This J&A supports Navy projects that must be accomplished within the timeframes states herein to avoid likely severe impact to mission critical functions and operations. Some specific examples of projects include:

Water Tank Inspections at Pax River and Indian Head, Water Tank Inspections Southeast Region, Water Tank Inspections Mid-Atlantic Region, J&A No. JA-26-0006

The follow-on contract was solicited, with adequate responses received from interested A-E firms. This bridge contract is necessary to ensure continuity of services while the review process for the follow-on contract is completed. The proposed contract action was not synopsized on the SAM website since this time increase is under the terms of an existing contract that was previously synopsized in sufficient detail. In accordance with FAR 6.305, the approved J&A will be posited on SAM.gov within fourteen (14) days after award of the contract modification.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer will determine that cost to the Government of the services covered by this Justification will be fair and reasonable in accordance with FAR Part 36.606 and FAR Part 15 for negotiations.

8. Actions to Remove Barriers to Future Competition.

A competitive follow-on contract is in process and is anticipated to be awarded by August 2026. The follow-on will be a Single Award, Indefinite Delivery, Indefinite Quantity contract.

The government has achieved adequate competition for this requirement, as demonstrated by the selection of three firms for interviews following a thorough evaluation of submissions.
