About this file
This is a Justification and Approval for Other Than Full and Open Competition (sole source procurement) for law enforcement services at Carr Creek Lake in Knott County, Kentucky.
The U.S. Army Corps of Engineers, Louisville District, is procuring law enforcement patrol services as a firm fixed price contract with a base year plus four option years, estimated at $108,500.00 total. The contractor shall provide basic patrol services across USACE-administered lands and waters within Knott County, including Dam Recreation Area, Tailwater Recreation Area, Spillway, Stilling Basin area, Littcarr Recreation Areas, Marina Recreation Area, Littcarr campground, and project office area. The base period runs from the date of award through March 31, 2027, with 310 patrols scheduled during the base year. Option years extend from April 1, 2027, through March 31, 2031. The contract is being awarded on a sole source basis to the Knott County Sheriff's Office because it is the only entity with legal jurisdiction to enforce state and county civil and criminal laws on the public lands, waters, and roads administered by USACE at this location.
The contracting officer conducted efforts to obtain competition by contacting the Kentucky Department of Fish and Wildlife and Kentucky State Police in January 2026. The Kentucky Department of Fish and Wildlife declined to bid due to resource constraints, and the Kentucky State Police did not respond by the January 15, 2026 deadline. The authority for this sole source procurement is FAR 13.106-1(b)(1)(i), supported by 32 CFR § 635.20(b) and Section 120(a) of the Water Resources Development Act of 1976, which authorize contracting with states and their political subdivisions for law enforcement services at water resource projects.
