About this file

This is a Memorandum for Record justifying the limitation of competition for a sole-source procurement at or below the Simplified Acquisition Threshold.

The Chemical & Biological Testing Division at U.S. Army Dugway Proving Ground requires preventative maintenance and repair services for two STERIS model ARD-120 Vaporized Hydrogen Peroxide (VHP) 1000 sterilizer units essential for decontaminating sensitive equipment and biological laboratories. The required services include annual inspection, cleaning, preventative maintenance, parts replacement, system calibration, and NIST traceable certification—the latter being mandatory for regulatory compliance and safe operation. The procurement is structured as a fixed-price purchase order using RDT&E funds for Fiscal Year 2026. The contract includes a one-year base period (01 JUN 2026 – 31 MAY 2027) with four one-year option periods and a Final Aging Rate clause period through 31 DEC 2031. The estimated total value is redacted in the document. Four line items are specified: preventative care services (2 units), calibration services with NIST certification (2 units), annual inspection travel charges (4 units), and unscheduled assessment/emergency repair call-out services (1 unit).

STERIS Corporation (5960 Heisley Road, Mentor, OH 44060-1834) is the sole proposed contractor. The justification cites FAR 12.201-1 authority for commercial acquisitions valued at or below the simplified acquisition threshold. STERIS is the only reasonable source because it is the Original Equipment Manufacturer with exclusive control over proprietary software, specialized tools, and diagnostic equipment, and only STERIS-certified technicians are authorized to perform mandatory calibration and generate official NIST certification reports. Market research included searches of GSA Advantage, AbilityOne, UNICOR, and the Federal Procurement Data System, plus a Sources Sought notice that yielded no viable alternatives. The government has established procurement history with STERIS on prior sole-source contracts W911S6-12-P-0136 and W911S6-21-P-0027, and the underlying facts remain unchanged. The document indicates this action does not require public synopsis posting under FAR 5.101 as it is below the $20,000 threshold, and no justification posting is required as this is not a brand name restriction under the Simplified Acquisition Threshold.

prohibitive and would involve a multi-year process of sourcing, purchasing, validating, and integrating entirely new equipment from a different manufacturer, resulting in an unacceptable period of operational failure and leaving a critical gap in mission readiness.

7. Publicizing Contract Actions:

a. The public display and synopsis requirements of FAR 5.101(a) and FAR 5.101(d) do not apply, less than $20K threshold apply and will be followed do not apply due to an exception at FAR 5.101(b)(1)

8. Market Research:

Market research was conducted by the contract specialist and CBTD personnel to determine the availability of vendors capable of providing the required annual certification, maintenance, and repair of STERIS VHP-1000-ARD equipment. The research confirmed that only the OEM, STERIS Corporation, can meet the government's needs due to the proprietary nature of the certification process.

Extensive market research was conducted across government and public databases, including GSA Advantage, AbilityOne, UNICOR, and the Federal Procurement Data System (FPDS). This comprehensive review yielded no alternative sources capable of servicing or certifying STERIS VHP equipment. General internet searches and a review of similar sole-source awards at DPG further supported this conclusion.

To ensure maximum exposure to potential vendors, a Sources Sought Notice was posted to the Government Point of Entry (GPE). While this notice generated responses from several small business vendors, a subsequent technical review by CBTD determined that none were capable of meeting the government's essential requirements. Specifically, no responding vendor could demonstrate access to the OEM's proprietary tools, software, and training necessary to perform the mandatory

calibration and certification. Direct correspondence with a STERIS representative and a formal sole-source letter from the company confirmed that while basic maintenance training is available, only STERIS-certified technicians are authorized to perform the official calibration and issue the NIST-traceable certification report required for federal and Department of War regulatory compliance. Therefore, the market research conclusively determined that STERIS Corporation is the only source capable of meeting the agency's needs.

9. Other Facts:

This is a follow-on requirement, and the Government has an established procurement history of awarding this service to STERIS Corporation on a sole-source basis. This history includes prior contracts W911S6-12-P-0136 and W911S6-21-P-0027. These previous awards were also sole-source, as the underlying facts of the requirement have not changed: STERIS remains the only entity with access to the proprietary software, tools, and certified technicians capable of performing the mandatory calibration and certification. This consistent procurement history underscores the enduring and unique nature of the OEM's capabilities. Continuity of service with the OEM is the only acquisition strategy that avoids mission failure and ensures regulatory compliance.
