About this file

This is a Justification for Other Than Full and Open Competition (J&A) document issued by the U.S. Department of Justice, Federal Prison Industries (UNICOR) Lompoc Farms facility.

UNICOR seeks to waive full and open competition to procure insecticide and fungicide spray application services for three crops totaling $58,000: Celery (60 acres, $22,000), Broccoli (60 acres, $16,000), and Cilantro (60 acres, $20,000). The justification is based on urgent and compelling circumstances under 41 U.S.C. 3304(a)(2), citing an unusually high and rapidly increasing volume of destructive insects infesting government-owned crop fields. The government asserts that conducting standard full and open competition with SAM.gov posting and normal solicitation timelines would result in substantial loss of government property, reduced yield, and mission impact due to the time-sensitive nature of agricultural assets. The contracting officer determined the anticipated costs are fair and reasonable based on analysis of prior similar service awards. Santa Maria Valley Crop expressed written interest in the acquisition. Competition will be pursued by soliciting quotes to known vendors in the area. The contracting officer and operations manager have approved the justification. UNICOR indicates it is developing a long-term contract solicitation for these services to prevent similar urgent situations in the future.

Lompoc Farms require insecticide, and fungicide spray application for various crops.

UNICOR wishes to waive other than full and open competition and negotiate with the potential vendor.

4. A description of the supplies or services required that meet the agency’s needs (including the estimated dollar amount).

Spray Application Celery 60 Acres $22,000.00

Spray Application Broccoli 60 Acres $16,000.00

Spray Application Cilantro 60 Acres $20,000.00

Total $58,000.00

5. Identification of the statutory authority permitting other than full and open competition.

41 U.S.C. 3304(a)(2)

6. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires the use of the authority cited.

The Government has an urgent and compelling need to procure immediate insect control services due to an unusually high and rapidly increasing volume of destructive insects infesting Government-owned crop fields. Recent field assessments indicate that the infestation is spreading at a rate that poses a direct and imminent threat to crop viability, with the potential to cause significant and irreversible damage if treatment is delayed.

The affected crops are time-sensitive agricultural assets whose value and usability degrade quickly when exposed to uncontrolled pest activity. Waiting to conduct a full and open competition, including posting to SAM.gov and allowing standard solicitation timelines, would result in substantial loss of Government property, reduced yield, and potential mission impact.

The infestation level exceeds normal seasonal expectations and constitutes an unusual and compelling circumstance requiring immediate action.

7. A description of effects made to ensure that offers are solicited from as many potential sources as is practical including whether a CBD notice was, or will be, publicized as required by Subpart 5.1 and, if not, which exception under 5.101 applies.

Quotes will be sent to know vendors in the area to allow competition.

8. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Using purchase history of similar services I have determined that the cost is Fair and Reasonable to the Government.

9. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

Analysis of purchase history was conducted of similar service awards was conducted.

10. Any other facts supporting the use of other than full and open competition.

12. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services are required.

Currently UNICOR is developing a solicitation to secure a long-term contract for these services to prevent this from happening in the future.

13. Contracting Officer’s certification that the information is accurate and complete to the best of the Contracting Officer’s knowledge and belief.

By signing the form, the contracting officer certifies the acceptability of the document.
