About this file
This document is a Justification & Approval (J&A) to sole source the Mass Warning Notification System (MWNS) requirement at Pease Air National Guard Base in Newington, New Hampshire to Acoustic Technology Inc. (ATI). The New Hampshire National Guard originally managed this effort through a terminated National Guard Bureau contract, and the hardware has been in storage since. The Government intends to sole source to ATI due to the proprietary nature of the equipment and ATI's prior involvement as a subcontractor. A sources sought notice was issued, but no other vendors besides ATI were able to respond that they could perform the required integration and configuration work on the existing ATI system. Contracting with ATI is determined to be in the Government's best interest to avoid the burden of redesigning the system from scratch.

MEMORANDOM FOR RECORD
SUBJECT: Justification & Approval to Sole Source Mass Warning Notification System (MWNS) requirement IAW FAR 6.302-1 (Only One Source)
1. BACKROUND: Pease Air National Guard Base (ANGB) requires the programing & installation of a Mass Warning Notification System on-site in Newington, NH. This work includes design work as well as the base-wide configuration of all components and integration with existing systems. National Guard Bureau (NGB) originally managed this effort through an agency-wide contract (W9133L-18-F-0042) with Microtechnologies. Unfortunately, NGB terminated it early in 2021 in response to COVID-19. ATI was a subcontractor to
Microtechnologies who was tasked with performance at Pease during that time. Although ATI delivered the system, they could not complete the site-work prior to termination. The hardware has been in storage ever since, and Pease must now contract independently to complete the project. The Government intends to sole source an award to ATI due to the equipment’s proprietary nature and as a logical follow on to the legacy contract.
a. All MNWS components are proprietary to ATI and contracting with another vendor risks voiding any existing warranties. The Government did attempt to identify potential 3rd party contractors by issuing a sources sought (W50S8A-25-Q-A001) on 24 Oct 24. The sources sought closed ten days later with no vendors— other than ATI— responding that they could do the work. This indicates that ATI has no 3rd party affiliates who are qualified to work on their equipment and only ATI technicians can maintain ATI systems.
b. Contracting with ATI is in the Government’s best interest given their prior involvement with the requirement. Since ATI equipment is proprietary to that company, competing that requirement effectively means designing and rebuilding the MNWS system from scratch.
This would involve fully burdened labor hours for technicians to provide a full system redesign as opposed to designing, configuring, and installing equipment that’s already in place. The Government is not likely to recoup these costs through wider competition.
