About this file

This document is a Justification and Approval (J&A) for a sole-source contract for facilities operations and support services for the DLA Disposition Services Headquarters existing Advantor alarm system. The contract is for alarm service and maintenance at the Hart-Dole-Inouye Federal Center in Battle Creek, Michigan, with an estimated value of $95,103.84, including one 12-month base period and four 12-month option periods. The sole-source justification is based on Advantor Systems Corporation being the only responsible source with proprietary rights to the software and hardware, and the technical expertise required to maintain the existing Intrusion Detection and Access Control alarm system.

The contract requires Original Equipment Manufacturer (OEM) parts, supplies, and proprietary knowledge for continuous monitoring and maintenance of the alarm system, which is critical for building and personnel security. Market research conducted by the Contracting Officer in GSA Advantage found potential vendors, but none are believed to have the specific technical capabilities needed. Replacing the existing system would require replacing all equipment, potentially causing a lapse in alarm services and facility security. The contract will be synopsized in SAM.gov, and the sole-source action can be revisited if additional acceptable sources are identified.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(1) AGENCY/CONTRACTING ACTIVITY:

DLA Disposition Services, J72.

(2) DESCRIPTION OF ACTION BEING APPROVED:

This sole source justification is intended to acquire facilities operations and support services for the DLA Disposition Services HQ facilities existing Advantor alarm system.

To issue a firm-fixed-price service contract under FAR 13 procedures, for alarm service and maintenance at the Hart-Dole-Inouye Federal Cetner in Battle Creek, MI., the monitoring and service work requires Original Equipment Manufacturer (OEM) parts, supplies, and proprietary knowledge to

FAR Subpart 13.5—Simplified Procedures for Certain Commercial Items

13.501 Special documentation requirements. (a) Sole source (including brand name) acquisitions.

(1) Acquisitions conducted under simplified acquisition procedures are exempt from the requirements in part 6. However, contracting officers must—

(i) Conduct sole source acquisitions, as defined in 2.101, (including brand name) under this subpart only if the need to do so is justified in writing and approved at the levels specified in paragraph (a)(2) of this section;

(ii) Prepare sole source (including brand name) justifications using the format at 6.303-2, modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901 or the authority of 41 U.S.C. 1903;

(iii) Make publicly available the justifications (excluding brand name) required by 6.305(a) within 14 days after contract award or in the case of unusual and compelling urgency within 30 days after contract award, in accordance with 6.305 procedures at paragraphs (b), (d), (e), and (f); and

(iv) Make publicly available brand name justifications with the solicitation, in accordance with 5.102(a)(6).

(2) Justifications and approvals are required under this subpart for sole-source (including brand-name) acquisitions or portions of an acquisition requiring a brand-name. If the justification is to cover only the portion of the acquisition which is brand-name, then it should so state; the approval level requirements will then only apply to that portion.

DFARS 13.501 Special documentation requirements. (a) Sole source (including brand name) acquisitions.

(i) For non-competitive follow-on acquisitions of supplies or services previously awarded on a non-competitive basis, include the additional documentation required by 206.303-2(b)(i) and follow the procedures at PGI 206.304(a)(S-70).

(ii) In accordance with section 888(a) of the National Defense Authorization Act for Fiscal Year 2017 (Pub. L. 114-328), the justification and approval addressed in FAR 13.501(a) is required in order to use brand name or equal descriptions or proprietary specifications and standards.

Justification and Approval (September 2020) Page 2 of 4 be on a sole-source basis using the authority cited in this justification. Estimated value is $95,103.84 including one (12 month) base period and four (12 month) option periods for the service.

(3) DESCRIPTION OF SUPPLIES/SERVICES:

The existing Advantor alarm system is necessary for building and personnel security. Continuous monitoring and maintenance are critical to the system maintaining the integrity of the security posture at the building. Any faults with the equipment will be repaired or replaced in accordance with the requirements outlined in the Performance Work Statement (PWS) and OEM standards.

(4) STATUTORY AUTHORITY:

Far 13.501, which requires preparation of sole source (including brand name) justifications using the format at FAR 6.303-2, modified to reflect an acquisition under the authority of the test program for commercial items. The specific FAR exception to full and open competition under the circumstances is FAR 6.302-1(b).

(5) DEMONSTRATION OF UNIQUE CONTRACTOR QUALIFICATION/NATURE OF ACQUISITION:

The DLA Disposition Services HQ in Battle Creek, MI, currently has an Intrusion Detection and Access Control alarm system that requires maintenance and monitoring throughout the operation of its performance. The incumbent has proprietary rights to the software and hardware and is the only responsible source to provide repairs, enhancements, upgrades, and technical support. Attached is supporting rationale from the Program Office on the justified need for sole source acquisition.

(6) SOLICITATION SOURCES/PUBLICATION:

In accordance with FAR 5.202, this justification will be synopsized in SAM.gov and should any indications of acceptable additional sources surface, the proposed sole-source action can be revisited for any future needs. Web-based research does show potential dealers of alarm systems, but it is not expected that they have technical expertise, including engineering design and other Original Equipment Manufacturer (OEM) considerations to accomplish the software and hardware requirements, including but not limited to the various system upgrades required.

(7) CONTRACTING OFFICER FAIR AND REASONABLE ANTICIPATED PRICE DETERMINATION:

Price analysis will be used to determine the fair and reasonableness prior to contract award.

(8) MARKET RESEARCH CONDUCTED:

In addition to the market research conducted by the Program Office as summarized above, and the J&A for this action will be publicized, the Contracting Officer searched in GSA Advantage to try to identify additional sources. Potential vendors are evident but are not believed to be viable sources for the unique

Justification and Approval (September 2020) Page 3 of 4 needs required. No other sources for the specific capabilities required under this action are known to exist.

(9) OTHER SUPPORTING FACTS:

The DLA Disposition Services Battle Creek, MI, currently has Advantor Intrusion Detection and Access Control alarm system that requires maintenance and monitoring throughout the operation of its performance.

The existing system requires proprietary rights to the software and hardware and Advantor is the only responsible source to provide enhancements, upgrades, and technical support. Using a different alarm system requires the replacement of all existing ones with completely different equipment which could result in a lapse of the alarm service necessities and security of the facility.

(10) SOURCES INTERESTED IN ACQUISITION:

Advantor Systems corporation

(11) ACTIONS TO REMOVE/OVERCOME BARRIERS TO COMPETITION FOR SUBSEQUENT

ACTIONS:

Actions have been described as above, and this is open to any other measures that can be identified for future actions.

The Advantor Intrusion Detection and Access Control Alarm system is the current existing Alarm system that requires maintenance and monitoring throughout the operation of its performance. Advantor is the only known source with access to the proprietary software and hardware required to maintain the integrity and operational status of the alarm system.

(12) CONTRACTING OFFICER JUSTIFICATION CERTIFICATION:

I certify that the supporting data included in the justification are accurate and complete to the best of my knowledge and belief.
