About this file

This is a Justification for Other Than Full and Open Competition (J&A) document for the Defense Logistics Agency (DLA) Troop Support, Construction and Equipment Supply Chain to increase the maximum dollar value of the Special Operational Equipment (SOE) Tailored Logistics Support (TLS) Program 5th Generation contracts. The document authorizes modification of four incumbent contracts to increase the program ceiling from $33 billion to $60 billion, representing a $27 billion increase in maximum ordering capacity. The SOE TLS Program is a multiple-award platform with post-award competition among six small business contractors: Atlantic Diving Supply Inc., Noble Supply and Logistics, SupplyCore Inc., W.S. Darley & Co., Federal Resources Supply Company, and Tactical & Survival Specialties Inc. The contracts were competitively awarded on January 5, 2021, with a two-year base period and four two-year option periods for a maximum ten-year term. The program provides commercially available SOE items including survival gear, tactical equipment, personal protection equipment, diving equipment, communication devices, and related support items to warfighters globally.

The justification cites statutory authority under 10 U.S.C. 3204(a)(1) and FAR 6.302-1, asserting that only the incumbent contractors can satisfy agency requirements within the required timeframe. Driving factors for the increased ceiling include unanticipated demand growth attributed to the Ukraine conflict, increased utilization of Unmanned Aerial Systems (UAS) and Counter-UAS equipment, expanded DLA customer base, higher equipment costs from cutting-edge technology integration, and inflation rates (2021-2025 ranging from 2.7% to 4.7%). The document states that no feasible alternatives exist to continuing with existing contractors and that increased maximum dollar value provides only additional ordering capacity without obligating award to any specific contractor. Delivery orders will continue to be competitively awarded among all contract holders on a bona fide basis. Price fairness and reasonableness will be ensured through post-award delivery order competition, ceiling price analysis, and alternative price evaluation techniques under FAR 15.404-1(b)(2).
