About this file

This is a Sole Source Justification under Simplified Acquisition Procedures for Certain Commercial Items (FAR 13.5) for the Department of Veterans Affairs, NCO 15 Contracting Office.

VISN 15 Medical Center requires a follow-on firm-fixed price service contract for maintenance and support of GE MUSE and CardioDay software systems, replacing expiring contract 36C25521P0511 upon its expiration on August 8, 2026. The contractor shall provide remote diagnostics, corrective maintenance, technical phone support, applications support, and onsite support as needed. Deliverables include unlimited phone technical support with 1-hour engineer response time, preventive maintenance and performance verification per manufacturer and Joint Commission requirements, unlimited onsite service and corrective maintenance, parts and labor, regulatory documentation, software upgrades and field change orders, clinical application support, business review, installation support, clinical education, scheduled technical support, and MUSE User Group tuition. The contract guarantees 99% uptime and includes vendor-provided hardware and software updates. The estimated minimum cost for replacing this technology through open competition would be $1 million, accounting for new server infrastructure, software installation, training, and implementation. Competition is restricted under FAR 13.5 based on "Only One Responsible Source" (FAR 6.302-1) because GE is the sole provider of maintenance for this FDA-regulated medical device. Market research conducted through SBA dynamic search, AddUp, Sam.gov, and GSA confirmed no other vendor can provide these specialized services. GE Healthcare, represented by Elan Elvaiah (M +1 262-227-9622, Elan.Elvaiah@GEHealthcare.com), expressed written interest. The justification was certified by Robert Hamilton (Supervisory Biomedical Engineer, VISN 15), approved by Jon Lutmer (Contracting Officer, NCO 15), and approved by Randall Combs (Division Chief, NCO 15).

The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

( ) Unusual and Compelling Urgency

Effective Date: 12/30/2025 Page 2 of 3 Revision: 02 Acquisition ID#: 36C255-26-AP-0198

( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services

( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition

Requires the Use of the Authority Cited Above (applicability of authority):

There is Only One Responsible Source (FAR 6.302-1) for the services provided under this contract action. This does represent a follow-on contract(36C25521P0511) for sustainment and continued development of a highly specialized software-based equipment. This equipment from GE is highly specialized because it is Food and Drug Administration (FDA) regulated medical device. The alternative to continuing services with the Original Equipment Manufacturer (OEM) would be to enter into an open market procurement action and compete to replace the technology altogether. This would be a substational duplication of costs, estimated at a minimum of $1M once accounting for new server infrasucture, software installation, training and other key implementation tasks. This action would also result in unnecessary delays. This means the existing MUSE and CardioDay software would not be covered by a maintenance agreement until the requirement were recompeted therefore, this should still be a follow up contract so there is no patient interruption. Only GE can provide these services to the MUSE equiqement/software.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Competition for a clinical, software-based system is typically coordinated when selecting the technology. Because of the highly specialized, propieatary nature of these systems, sustainment of them is generally highly regulated and the candidate pool is inherently limited. To solicite and find a new contract would be determental to the VA for the period that the new contract is taking place. To wait for a new contract would ultimately put the patient at risk and would have to send the patient to an outside hospital. Ultimately creating a duplicate cost in having the patient go to an outside hospital that could extend the waiting period for that procedure and creating a new contract which could be the same vendor as now. A sole source procurement is in the best interest of the government and patient.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

This follow on contract is fair and reasonable to the government and will not create any period that the veteran wouldn’t be seen. There wouldn’t have to be any veteran that would have to go to an outside hospital which ultimately could be a longer wait time dealing with the public hospitals.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

Market research was conducted through search on SBA dynamic search, AddUp, Sam.gov, and GSA there was no other business that can provided these services other than GE. While there is other businesses who provided maintenance services these types of services can only be provided by the OEM in GE. There is no other vendor who can provide there services.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

There are no other facts supporting use of other than full and open competition.
