About this file
This is a Justification and Approval (J&A) document for a contract modification under the Federal Acquisition Regulation (FAR) permitting use of other than full and open competition.
The Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC), Hawaii, seeks to increase the maximum not-to-exceed value of its Fiscal Year 2022 Service-Disabled Veteran-Owned Small Business (SDVOSB) Multiple Award Construction Contract (MACC) by $35,000,000, from $98,000,000 to $133,000,000. The modification applies to five SDVOSB contractors: AN41-AAK JV, LLC; DSQ-API JV, LLP; Hawk-Niking, LLC; Tokunaga Elite JV, LLC; and Warfeather-GM JV, LLC, awarded on June 1, 2022, with a base year and four one-year options expiring May 31, 2027 or upon reaching the not-to-exceed amount, whichever occurs first. The work encompasses labor, supervision, tools, materials, and equipment for new construction, repair, alteration, and related demolition of infrastructure throughout the State of Hawaii under Design-Build and Design-Bid-Build requirements. The capacity increase is justified by the drastic and unforeseen depletion of funds during the first three years due to unplanned Commander and Marine Corps installations requirements, which inhibits the Government's ability to award projects in the remaining option year. The statutory authority cited is Title 10 U.S.C. Section 3204(a)(2) based on unusual and compelling urgency. The J&A will be posted on SAM.gov within 14 days after contract modification approval.
