About this file

This document is a justification for other than full and open competition for a federal contract. The Defense Logistics Agency requires Motorola/Zebra brand name RF handheld hardware, scanners, accessories, and OneCare support to replace aging inventory used across its global supply centers. The specialized equipment was customized and integrated over two years for DLA's warehouse management and security systems. Only Motorola/Zebra parts and warranties are compatible with existing devices to avoid voiding warranties. Market research found only one authorized reseller, CDO Technologies, can provide the required support. The estimated contract value is redacted. The solicitation will be posted on SAM.gov as a request for proposal with pricing determined fair based on various price analysis techniques.

3. DESCRIPTION OF SUPPLIES/SERVICES:

DLA has a requirement to procure Motorola/Zebra Hardware Scanners, Accessories and OneCare Support for the DLA Technology Foundation Services (TFS-DCBA) office. The ordering period for this acquisition shall be for 12 months from date of award. The overall estimated value for this requirement is . This estimate includes an initial order, and potentially twelve (12) optional Contract Line Item Numbers (CLINs). If the Government decides to exercise any of the Optional CLINs it will do so within 12 months from date of award.

The Zebra RF handheld hardware requirements are listed below:

SEE ATTACHMENT 1 – BILL OF MATERIALS

4. IDENTIFICATION OF STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is Title 10, U.S.C 2304 (c), (1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy the agency requirement.”

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

In accordance with FAR 6.302-1, brand name Motorola/Zebra is essential to the Government’s requirement because the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy the agency’s requirements. A brand name, whether available on one or more contracts, is an item peculiar to one manufacturer and may be procured by brand name specification if essential to the Government’s requirements. The Motorola/Zebra brand name specification is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

The Motorola\Zebra Hardware Scanners, Accessories and Warranty are being procured to provide additional inventory to the current line of Radio Frequency (“RF”) terminals in use at DLA Supply Centers worldwide. DLA currently has approximately 4,000 Motorola/Zebra RF devices deployed across the globe to provide Defense Security Service (“DSS”) capability in the DLA Warehouse Management System (“WMS”). The Motorola/Zebra RF devices have been specifically configured for the DLA DSS Software System. This Zebra device integration was a major overhaul to the entire DLA Enterprise worldwide based on direction by DLA Chief Information Officer in the efforts to increase overall simplification of device management as well as proficiency in warehouse operations utilizing the latest technology that met DLA’s operational goals.

The Motorola/Zebra Hardware scanners have specific hardware and keypad components designed specifically for the DLA and also specific software scripting technology such as Soti/Mobi Control and Staylinked software technology (terminal emulation software) which integrate into the Zebra and DLA DSS mainframe; therefore three types of software are integrating together. The Zebra devices have highly specialized barcoding features (Soti/Mobi Control) which aligns with the enterprise management software and DLA DSS. Additionally, Zebra created customized keyboards and touchpads for DLA use only. These customized keyboards and touchpads have unique and specialized features that enable DLA warehouse workers to meet their everyday mission of picking, packing and stowing the materials needed more efficiently by the warfighter. Most importantly, very particular DoD encryption software (DoD 140-2 Policy) and hardware features which meet DoD IT security measures have been tested, configured, and incorporated into both CONUS and OCONUS locations. The configuration, testing and integration of these devices in the DLA Warehouse Management System took approximately 2 years. DLA has made an enormous investment into this specialized technology. It is expected that it would take an additional 2+ years to configure, adapt and incorporate a new piece of equipment for use in the DLA WMS and DLA DSS, which does not meet DLA’s current timeline for the need of upgraded inventory. Furthermore, only Motorola/Zebra brand name warranty and third-party spare parts meet the Government’s needs, since use of third-party warranty or spare points would result in voiding all warranties for existing and future devices.

In order to ensure the in-use devices have the appropriate spares and accessories, only this model is compatible with some of the previously purchased accessories (i.e., battery chargers, accessory cabling). If we were to use any other brand of devices and parts they would not be compatible with our current line of RF terminals; and therefore would be unusable in our system. The Zebra MC93 and VC83 is an upgraded terminal from the RF terminals that we are currently utilizing, and the MC93 and VC83 line of spare parts and accessories will work with some of the current RF terminal inventory that we are using in our DLA Warehouse management system. There is no other device on the market which can be used in our current WMS and the spare parts from another brand are not compatible with the Zebra equipment that we currently - in production.

The parts and accessories which have been ordered - are proprietary equipment from Zebra.

If we are unable to continue to purchase this equipment, we will have no spare, batteries or replacement terminals for our current line of RF terminals.

6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES:

The current action will be issued as a Combined Synopsys/Solicitation-Request for Proposal (RFP) posted to the Contract Opportunities website (www.sam.gov/) in accordance with FAR 5.201(b). All responsible parties will be given an opportunity to submit an offer.

7. DETERMINATION OF FAIR AND REASONABLE COST:

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various prices analysis techniques including, but not limited to: (1) comparison with competitive published price lists (reference FAR 15.404-1(b)(2)(iv); and (2) comparison of proposed prices with prices obtained through market research of the same or similar items (reference FAR 15.404- 1(b)(2)(vi); (3) Comparison of proposed prices to historical prices paid, whether by the Government or other than the Government, for the same or similar items (FAR 15.404- 1(b)(2)(ii)); (4) Comparison of proposed prices with the Independent Government Cost Estimate (FAR 15.404-1(b)(2)(v)).in order to obtain a fair and reasonable price.

8. MARKET RESEARCH:

Market research actions were conducted by the DLA Program Office between February 2021 – July 2021 and it was determined only one authorized reseller of the required support is available to support this requirement. There is a certification letter in the contract file demonstracting such. The findings from this market research subsequently confirmed that only the subject reseller (CDO Technologies) are capable of providing the required support. A decision was made to issue the requirement via a Combined Synopsis/Solicitation – Request for Proposal via SAM.gov to disseminate the requirement to the maximum number of potential sources to fulfill the posting requirements.

9. ANY OTHER SUPPORTING FACTS:

Only Zebra brand name hardware currently meet the Government’s needs. Providing another RF device would require considerable lead time and training to reconfigure the new device to operate in the current DLA WMS environment. This would lead to an unacceptable delay and would not be cost efficient. In addition, a second device would require that warehouse employees are trained on utilizing two separate RF devices. This could result in a negative impact to productivity as users will need to be provided with additional time and training on how to use the keypad function keys of the new devices. There are no other devices, other than OEM Zebra brand hardware, that have all of the proper capabilities for the end-user to -perform their job. Lastly, the use of other third-party devices, support, or spare parts even if comparable would result in voiding all warranties for existing devices because only the compatible part must be used to maintain the warranty. DLA would incur higher costs for support and spare parts if not under warranty because spare parts would not be available otherwise, and the entire device would need replacing. The cost of a new device is about four times the cost of covering that device with a warranty.

10. LISTING OF INTERESTED SOURCES:

The following firms have expressed interest in this requirement: CDO Technologies

BARRIERS THAT LED TO THE EXCEPTION TO FULL AND OPEN

COMPETITION:

At this time, the required Motorola/Zebra Hardware, Scanners, Accessories and OneCare Warranty are the only products that will support DLA’s requirements and meets the Government’s needs. However, DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both within industry and the Government, ad continuing effort within DLA. Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure future full and open competition.
