JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION UNDER
AUTHORITY OF 10 U.S.C. 2304(c)(1) FOR FULL FOODSERVICE PRIME VENDOR
CUSTOMERS IN NORTHERN NEW YORK AND SURROUNDING AREAS
1. Defense Logistics Agency (DLA) Troop Support, Subsistence Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements on an other than full and open competition basis.
3. The proposed acquisition will be an Indefinite-delivery, Indefinite-quantity (IDIQ), fixed price with Economic Price Adjustment (EPA) bridge contract for Subsistence Prime Vendor (SPV) support for a period of 213 days, which includes coverage for a sixty day
(60) ramp-up period for the follow-on competitive procurement to allow for implementation activities such as the establishment of a Subsistence Total Order and Receipt System (STORES) catalog by the awardee.
The proposed bridge contract (SPE300-21-D-3310) encompasses SPV support for all authorized DLA customers located in the Northern New York and Surrounding Areas for a full-line of food and beverage items. Based on current annual usage/sales, the estimated total dollar value for the proposed bridge contract is $1,950,202.37. The guaranteed minimum dollar value is ten percent (10%) of the estimated dollar value, or $195,020.24.
The maximum total dollar value, includes surge of 210%, is, $4,095,424.98. This proposed action will result in the award of a bridge contract to Renzi Food Service effective January 25, 2021 through August 25, 2021.
4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR Part 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. The use of this authority is necessary to provide continuous, uninterrupted food supplies to DLA customers in Northern New York and Surrounding Areas. The last Long Term Prime Vendor contract covering this region was a fixed price with EPA IDIQ contract (SPE300- 14-D-3012) awarded to Renzi Food Service on June 30, 2014 and expired on July 29, 2019.
Contract SPE300-14-D-3012 had a base period of up to twenty-four (24) months, which included a two (2) month implementation period and a twenty-two (22) month ordering period, and was followed by one (1) twelve (12) month option period and one twenty-four
(24) month option period.. The contract was awarded utilizing full and open competition and had a maximum contract dollar value of $33,600,000.00. The first bridge contract for a period of 361 days was effective July 30,2019 through July 25, 2020. The second (current) contract, SPE300-20-D-3285, is a 182 day bridge contract awarded on July 31, 2020 and due to expire January 24, 2020. The proposed action will result in the award of a third bridge contract to Renzi Food Service effective January 25, 2021 through August 25, 2021.
The delays necessitating the first and second bridge contract are documented in the Justification and Approval (J&A) to support that contract action. This bridge contract is necessary due to occurrences as discussed below.
CUSTOMERS IN NORTHERN NEW YORK AND SURROUNDING AREAS
A fully competitive solicitation for this region was issued on January 6, 2020 with an initial closing date of February 6, 2020, which was extended to February 26, 2020 to clarify estimated dollar value requirements and to add a list of items that the offerors are required to stock for one of the solicitation customers.
With the onset of the COVID 19 pandemic in early March, technical evaluations were significantly delayed.

The required food service supplies are deemed to be available only from the current contractor in the timeframe required, and award to any other source would result in unacceptable delays in fulfilling the agency’s requirements. Renzi Food Service is able to meet the DLA requirements starting on January 25, 2021. They are the only food supplier in the Northern New York and Surrounding Areas that has a fully implemented STORES electronic catalog, which, alone, requires at least sixty (60) days, the total duration of ramp-up/implementation period. Award to any other potential food supplier would cause an unacceptable break in supply.
