About this file
This is a Justification and Approval (J&A) document for a sole source contract modification to extend custodial services to the Naval District Washington (NDW).
The Naval Facilities Engineering Systems Command (NAVFAC) Washington requests authorization to extend contract N4008019D0306 with NJS Joint Venture, LLC through a bridge modification covering a 2-month base period (01 October 2026 – 30 November 2026) with ten optional 1-month periods extending through 30 September 2027. The contract provides critical janitorial and custodial services to Navy facilities in the National Capital Region, including Navy Yard, Patuxent River, Indian Head, Carderock, and the Naval Observatory. Funding will be provided through FY27 Operations and Maintenance (O&M) appropriations from various customers. The estimated contract value is redacted in the document; pricing includes both recurring work and non-recurring work components.
The justification invokes 10 U.S.C. 3204(a)(2) for unusual and compelling urgency under FAR 6.302-2, citing delays caused by two GAO pre-award protests (received 16 March 2026 and 22 May 2026) that prevented timely evaluation and award of the follow-on competitive procurement. NJS has performed custodial services since 2020 and requires no transition phase, enabling seamless continuation of services critical to military operations. The original award target was 30 April 2026 with a 30-day transition period, but competitive procurement cannot be completed within the required timeframe. The follow-on contract will be competitively solicited as an 8(a) small business set-aside with a planned award date of 30 September 2026, with no further bridge contracts anticipated.

4) Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C.
3204(a)(2), Unusual and compelling urgency, as implemented by Federal Acquisition Regulation (FAR) 6.302-2.
5) Rationale Justifying Use of Cited Statutory Authority.
The regional Custodial Services contract provides critical janitorial services to facilities and installations in the National Capital Region. No other contract vehicle exists that could be used to meet the regional custodial services requirements. The impact of not providing custodial services to these installations will severely impact operations at Navy Yard, Patuxent River, Indian Head, Carderock, Naval Observatory and potentially result in mission failure. Even a short gap in services could negatively impact life, health, safety, and mission.
The work is scheduled to commence in December 2026.
The services under this requirement are being provided by NJS, NJS has been supporting the custodial services contract since 2020. NJS has extensive knowledge of the required services. Its familiarity with custodial operations and procedures allow NJS to seamlessly continue performance. In addition, NJS does not require a transition phase because they are already performing the work and providing the services. Executing this contract action will avoid the risk associated with not having ample time to transition and start full performance. NJS possesses the manpower and skill levels to provide the required services without a learning curve or additional phase-in/mobilization requirements. Failure to award a bridge modification to NJS could severely compromise services and negatively impact life, health, and safety.
The need for a third bridge contract is due to GAO pre-award protest was received on 16 March 2026, which subsequently delayed proposal evaluations pending resolution of the GAO protest. After GAO’s decision to dismiss, an additional GAO protest was received on 22 May 2026 on a different matter, which further delayed the evaluation pending resolution of the protest.
Subj: JUSTIFICATION AND APPROVAL FOR CONTRACT N4008019D0306, REGIONAL 8(a) CUSTODIAL SERVICES, NAVAL DISTRICT WASHINGTON
The original planned date of award was 30 April 2026, with a 30-day transition during the month of May 2026. The new services were due to start 01 June 2026. There is insufficient time to synopsize this action, solicit offers, conduct source selection, negotiate, and award an interim, short-term contract to perform these services. Time constraints prevent both the timely award of the new contract and the required 30-day phase-in period for the new contractor. The anticipated costs to competitively award a short-term bridge contract are believed to exceed any savings that would be generated through competition and there will be a gap in services if no action is taken. The proposed J&A will be synopsized on the Government Wide Point of Entry (GPE) as a sole source contract modification to NJS, upon approval of this J&A.
In order to ensure a smooth transition and maintain performance of the current services, a bridge is requested to allow for proper evaluation of proposals received, and conduct negotiations, and to allow for a 30-day phase-in period as required by the solicitation details.
6) Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
This proposed action is being requested under FAR Part 6.302-2 Unusual and compelling urgency. There is insufficient time to synopsize this action, solicit offers, conduct source selection, negotiate, and award an interim, short-term contract to perform these services.
7) Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8) Actions to Remove Barriers to Future Competition.
The follow-on procurement will be solicited as a competitive 8(a) small business set-aside under the 8(a) Business Development Program. The pre-award evaluation is pending and has a planned award date of 30 September 2026. No further bridge contracts are anticipated for this requirement. The bridge contract is being requested as an interim measure until the new contract is awarded.
