About this file

This document includes a justification and approval for a sole-source contract, as well as a related solicitation. Norfolk Naval Shipyard seeks to award a firm-fixed-price contract to Curtiss-Wright Electro-Mechanical Corporation, as the original equipment manufacturer, for the procurement of a Rotational Deployment Mechanism repair kit and refurbishment services. The refurbishment will take place at the contractor's facility. Responses to the solicitation are due by May 24, 2023. DEPARTMENT OF THE NAVY

NORFOLK NAVAL SHIPYARD

PORTSMOUTH, VIRGINIA 23709-

J&A Number:

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The Naval Sea Systems Command (NAVSEA), Norfolk Naval Shipyard (NNSY), Code 400 Contracts Department (C400), Portsmouth, VA.

2. Description of the Action Being Approved.

Award of a firm-fixed-price contract to Curtiss-Wright Electro-Mechanical Division, the Original Equipment Manufacturer (OEM), on a sole source basis for the procurement of repair material, disassembly, inspection, repair, and testing of the Rotational Deployment Mechanism (RDM), which is part of the Secondary Propulsion System (SPS) Repairs will be performed at the contractor’s facility.

3. Description of Supplies/Services.

NNSY requires the repair and refurbishment of the RDM .

The proposed requirement provides for the Original Equipment Manufacturer (OEM) to procure the replacement material kit and provide the refurbishment of the RDM, including inspections, repairs, and testing of the Secondary Propulsions System RDM, including the Training Motor and Rotary Joint . The replacement material kit, which requires significant lead time, are to be provided by the OEM under this contracting effort.

The anticipated period of performance and total estimated dollar value of the proposed contracting effort under this acquisition is summarized below:

The Contracting Officer has coordinated with the necessary stakeholders to ensure sufficient and appropriate funding are programmed into the budgetary process for FY23. Funding for the contracting actions will be requested and received prior to award.

4. Statutory Authority Permitting Other Than Full and Open Competition.

41 U.S.C 1901 as implemented by Federal Acquisition Regulation (FAR)Subpart 13.5 - Simplified Procedures for Certain Commercial Items.

5. Rationale Justifying Use of Cited Statutory Authority.

Curtiss-Wright Electro-Mechanical Division (Curtiss-Wright) is the OEM and maintains proprietary drawings required to execute the required repair/modifications and is experienced in supplying the replacement material. Currently the OEM is the only known vendor that can complete the repair/modifications and satisfy the appropriate procedures.

Therefore, based on the above, the acquisition strategy is to award a contract for the required supplies/services to Curtiss-Wright on a sole source basis in accordance with FAR 13.5.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Sources Sought Notice was posted on the SAM.gov website on 14 March 2023 and closed on 21 March 2023 in order to identify any other capable sources to accomplish the required services and provide the necessary parts.

Further, historical contract actions executed by other Shipyards were reviewed. The OEM, Curtiss-Wright, has provided virtually identical services for RDM Repair Kit and Refurbishment under Portsmouth Naval Shipyard (PNSY) sole source contracts SPMYM318P3056 and N39004019C0009 Additionally, the OEM, Curtiss-Wright has provided virtually identical services under Pearl Harbor Shipyard & Intermediate Maintenance Facility (PHNS & IMF) sole source contracts N3225319C0003 and N3225320C0005 and SPMYM417P0578 and

Notes

Market research conducted refurbishment services for the RDM ), concluded that Curtiss-Wright Electro-Mechanical Corporation was the only qualified vendor that has the capability to perform the repair. As a result, Curtiss-Wright was awarded the sole source contract N4215822PS233 for the refurbishment of the RDM.

Historically speaking, market research conducted by PHNS & IMF, Justification and Approval (J&A) Number 020103, dated 2020, for refurbishment services for the RDM on the USS Mississippi (SSN-782), and concluded that Curtiss-Wright Electro-Mechanical Corporation was the only qualified vendor that has the capability to perform the repair. As a result, Curtiss- Wright was awarded the sole source contract N3225320C0005 for the refurbishment of the RDM. PHNS & IMF documented market research for J&A Number 021074, dated June 16, 2021 for procurement of long lead time materials for the refurbishment of the RDM for a “Virginia Class Submarine,” concluding that Curtiss-Wright was the only capable vendor to provide the materials for the RDM refurbishment.

Notice of this justification will be provided on SAM.gov in accordance with FAR 6.305. The Contracting Officer, as required by FAR 5.201, will post a synopsis to the Government Point of Entry – SAM.gov detailing the intended acquisition strategy.

No other vendors at this time has the capabilities to perform this service

8. Actions to Remove Barriers to Future Competition.
