About this file

This justification document describes a proposed sole source contract award by the Department of Veterans Affairs to Feith Systems and Software, Inc. for brand name software maintenance support and upgrades. The VA requires maintenance for proprietary Feith software products currently used by the VA Infrastructure Operations division to provide operational support systems for the National Cemetery Administration. The software maintenance support will provide quarterly software updates and upgrades, as well as security releases within 48 hours. The period of performance is 12 months with two 12-month option periods. The justification cites 41 U.S.C. 3304(a)(1) and states that due to the proprietary nature of the Feith software, only Feith has access to source code and interfaces required to develop and implement updates. The related solicitation seeks proposals for the software maintenance by the November 1, 2022 deadline, with an anticipated award date of November 2, 2022.

Based on all of these market research efforts, the Government's technical experts have determined that only the aforementioned Feith brand name software maintenance support can meet all of the Government's needs.

Finally, in an email dated September 21, 2022, Feith notified VA that Feith is the only source that can provide VA with its current Feith maintenance and license configuration support, and there are no authorized partners or resellers for these offerings.
