About this file

This is a Justification and Approval (J&A) document for a sole source contract award dated 16 July 2026. The Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC) Atlantic, located in Norfolk, VA, seeks authorization to award a sole source contract to the American Society for Testing and Materials (ASTM) for web-based subscription services to ASTM International materials and standards collections in accordance with FAR 6.103-1.

The contract will provide web-based subscription services granting instantaneous access and 24/7 availability to ASTM Complete Book of Standards, including all volumes and sections of active and historical standards. Access will be available to DoD employees of NAVFAC, Marine Corps PWD (USMC), U.S. Army Corps of Engineers (USACE), 249th Engineering Battalion (USACE), U.S. Army (Army), U.S. Air Force Civil Engineering Center (AFCEC), U.S. Air Force and Space Force Base Civil Engineering Squadrons (US Space Force), Office of the Undersecretary of Defense, Sustainment (OSD), and Washington Headquarters Services (WHS). The contract will be Firm-Fixed Price with one base year and four one-year option periods, commencing 30 September 2026. The total contract duration shall not exceed 60 months for ordering purposes, with an estimated completion date of 29 September 2031. Funding will be provided by FY25 Military Construction Design (MILCON). The justification notes that ASTM holds exclusive copyright ownership and proprietary control of these standards; only direct digital subscriptions through ASTM's proprietary platform (ASTM Compass) or individual standard purchases directly from ASTM can meet the government's requirement for guaranteed immediate access to critical updates without user, IP range, or download volume restrictions. A SAM.gov synopsis was posted on 16 July 2026, and three firms responded but none were capable of providing the required ASTM services.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is Title 10 U.S.C.

2304(c)(1) and 10 U.S.C. 3204(a)(1), as implemented by Federal Acquisition Regulations (FAR) 6.103-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

ASTM standards are proprietary standards that ASTM creates and publishes. ASTM is the sole developer, publisher, and copyright holder of the standards, and ASTM does not relinquish its intellectual property rights to these standards. While third-party aggregators occasionally act as resellers for print or individual PDF copies, ASTM is the single authoritative source of the data.

Only a direct digital subscription with ASTM will meet the government requirement to possess ASTM standards that provide authoritative, zero-latency updates, access to historical version tracking, and proprietary native redline comparison tools required for mission-critical quality assurance and safety compliance. Thus, only ASTM can satisfy government requirements.

The ASTM International web-based subscription was originally procured within a package of Non-Government Standards Internet Subscriptions; contract N6247023C0007 with Allium US Holding LLC. Option Year Two for N6247023C0007 expires 30 September 2026, and as stated above, the ASTM International subscription must be descoped from Contract N6247023C0007 and acquired as a standalone contract.

To access ASTM standards digitally, the Government is required to procure dedicated, standalone, proprietary subscriptions directly from ASTM International's proprietary platform, ASTM Compass, or buy individual standards directly from ASTM. All of the above procurement methods are only available through ASTM. No other source provides access to these proprietary publications.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The proposed contract action was synopsized on the Opportunities section of SAM.gov on 16 July 2026 and three (3) firms responded indicating their interest in government contract opportunities and in adjacent digital engineering support. None of the three (3) firms are capable of providing access to the ASTM International materials and standards collection. The synopsis stated that the proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.103-1. No additional market research was conducted because research indicated only a direct digital subscription with ASTM (via the ASTM Compass platform) would meet the government requirement to have guaranteed immediate access to critical updates without restricting concurrent users, specific IP ranges, or total download volumes. ASTMs exclusive copyright ownership, and the proprietary nature of their standards and digital delivery platform ensures the Government receives unrestricted, enterprise-wide digital access without third-party limitations.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government for the supplies/services covered by this J&A will be fair and reasonable

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVFAC Atlantic has no plans at this time to compete future contacts for the types of supplies/services covered by this document. As mentioned above, there are no other sources capable of providing the subscription services for this requirement;

however, if another potential source emerges, NAVFAC Atlantic will assess whether competition for future requirements is feasible.

This Justification and Approval for other than full and open competition will be made publicly available on SAM.gov in accordance with FAR 6.301.
