About this file
This justification document approves awarding a bridge contract on a sole source basis to Pocono Pro Foods. The proposed 213-day bridge contract, valued between $235,332.51 minimum and $4,941,982.64 maximum, will provide continuous subsistence prime vendor support for all authorized Defense Logistics Agency customers in New Jersey, Eastern Pennsylvania, Southern New York, and surrounding areas. The bridge contract, number SPE300-21-D-3309 and effective January 25, 2021 through August 25, 2021, is necessary due to delays in awarding a follow-on long term contract and will allow for catalog implementation activities by the awardee prior to the new competitive contract. Pocono Pro Foods is the incumbent contractor, having held the last full and open contract that expired July 29, 2019 as well as two previous bridge contracts.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION UNDER
AUTHORITY OF 10 U.S.C. 2304(c)(1) FOR FULL FOODSERVICE PRIME VENDOR
CUSTOMERS IN NEW JERSEY, EASTERN PENNSYLVANIA, SOUTHERN NEW YORK
AND SURROUNDING AREAS
1. Defense Logistics Agency (DLA) Troop Support, Subsistence Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements on an other than full and open competition basis.
3. The proposed acquisition will be an Indefinite-delivery, Indefinite-quantity (IDIQ), fixed price with Economic Price Adjustment (EPA) bridge contract for Subsistence Prime Vendor (SPV) support for a period of 213 days, which includes coverage for a sixty day
(60) ramp-up period for the follow-on competitive procurement to allow for implementation activities such as the establishment of a Subsistence Total Order and Receipt System (STORES) catalog by the awardee.
The proposed bridge contract (SPE300-21-D-3309) encompasses SPV support for all authorized DLA customers located in the New Jersey, Eastern Pennsylvania, Southern New York, and Surrounding Areas for a full-line of food and beverage items. Based on current annual usage/sales, the estimated total dollar value for the proposed bridge contract is $2,353,325.07. The guaranteed minimum dollar value is ten percent (10%) of the estimated dollar value, or $235,332.51. The maximum total dollar value, includes surge of 210%, is $4,941,982.64. This proposed action will result in the award of a bridge contract to Pocono Pro Foods effective January 25, 2021 through August 25, 2021.
4. The applicable statutory authority permitting other than full and open competition is
10 U.S.C. 2304(c)(1), as implemented by FAR Part 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. The use of this authority is necessary to provide continuous, uninterrupted food supplies to
DLA customers in New Jersey, Eastern Pennsylvania, Southern New York, and Surrounding Areas. The last Long Term Prime Vendor contract covering this region was a fixed price with EPA IDIQ contract (SPE300-14-D-3011) awarded to Pocono Pro Foods on June 30, 2014 and expired on July 29, 2019. Contract SPE300-14-D-3011 had a base period of up to twenty-four (24) months, which included a two (2) month implementation period and a twenty-two (22) month ordering period, and was followed by one (1) twelve
(12) month option period and one twenty-four (24) month option period. The contract was awarded utilizing full and open competition and had a maximum contract dollar value of $79,800,000.00. The first bridge contract for a period of 361 days was effective July 30, 2019 through July 25, 2020. The second (current) bridge contract, SPE300-20-D-3284, is a 182-day bridge contract effective July 26, 2020 and due to expire January 24, 2021. The proposed action will result in the award of a third bridge contract to Pocono Foods effective January 25, 2021 through August 25, 2021.
The delays necessitating the first and second bridge contract are documented in the Justification and Approval (J&A) to support that contract action. This bridge contract is necessary due to occurrences as discussed below.
