About this file

This is a Justification and Approval for Other than Full and Open Competition (sole source justification) under FAR Part 13 for a services contract with Uniformed Services University of the Health Sciences (USUHS), Acquisitions Directorate.

The contracting activity seeks to award a firm fixed price sole source contract to BryMak for qualified plumbing and HVAC support services at USUHS. The requirement covers preventive maintenance, service call/work order response, and emergency maintenance on plumbing and HVAC systems across the University campus. The contract includes a 12-month base year with one 12-month option year (total estimated value is redacted). The justification cites urgency as the basis for sole source procurement under FAR 5.02(a)(2), noting that the Government's in-house plumbing and HVAC workforce has experienced a 50% reduction in staffing due to retirements and voluntary separations over the past 14 months. The remaining workforce cannot sustain both reactive maintenance operations and required preventive maintenance, resulting in a growing backlog of deferred maintenance and increased risk of critical system failures affecting facility operations, regulatory compliance, and mission readiness. BryMak is identified as the only reasonably available source because it currently works via USUHS's existing AFRRI facilities contract, maintains on-site presence with established security clearances, possesses familiarity with Government CMMS and facility systems, and can provide rapid mobilization without lead time delays. No other sources expressed written interest in the acquisition. The contracting officer determined that anticipated costs will be fair and reasonable. The justification was approved by both the Contracting Officer and Competition Advocate (Small Business).

8. Any other facts supporting the use of other than full and open competition:

In the last 14 months, the Government’s in-house plumbing Operations and Maintenance program has lost roughly 50% of internal support. The remaining workforce is insufficient to sustain both day-to-day reactive maintenance operations and the required preventive maintenance program.

As a direct result, the Government has been unable to complete preventive maintenance on critical building systems, including but not limited to HVAC, domestic water, sanitary waste, and medical gas systems. The growing preventative maintenance backlog accelerates equipment degradation, increases the likelihood of unplanned system failures and raises the long-term cost of deferred maintenance.

9. Listing of the sources, if any, that expressed, in writing, an interest in the acquisition:

No other sources have expressed an interest, in writing, in the proposed acquisition.

10. Statement of the actions, if any, the agency may take to remove or overcome any barrier to competition before any subsequent acquisition for the supplies or services required:

The Government will continue to monitor the marketplace to attempt to remove the current barriers due to the urgency surrounding the failing infrastructure. Any potential subsequent requirements will work toward removing the barriers to competition.
