About this file

This document is a Justification and Approval (J&A) for using other than full and open competition to procure Monaco fire alarm system panels for a project to modernize the base-wide fire alarm system at Pease Air National Guard Base in Newington, New Hampshire. The U.S. Army Corps of Engineers, New England District will issue an invitation for bid solicitation for the construction project, which includes installing new Monaco fire alarm panels in 22 buildings at an estimated cost of $210,000. FOR OTHER THAN FULL AND OPEN COMPETITION

Fire Alarm System Components Modernize Base-Wide Fire Alarm Project

New Hampshire Air National Guard Pease National Guard Base, New Hampshire

Solicitation No. W912WJ20B0006

1. CONTRACTING AGENCY

The U.S. Army Corps of Engineers (USACE), New England District (NAE), Contracting (CT), 696 Virginia Road, Concord, MA 01742.

2. DESCRIPTION OF ACTION

This project is a New Hampshire Air National Guard (NHANG) requirement. USACE is the servicing agency authorized under the Chief’s Economy Act, 10 U.S.C. § 3036 and thus responsible for the acquisition and administration of a new construction contract to modernize the Base-Wide Fire Alarm System at the Pease Air National Guard Base (Pease) in Portsmouth, NH. Funding for this acquisition will be Sustainment, Restoration and Maintenance funds and be provided by the Air National Guard. This Justification and Approval (J&A) covers only the portion of the acquisition which is brand-name or particular to one manufacturer. The use of such brand name description is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

The construction contract for the Modernization of the Base-Wide Fire Alarm Project will be a firm fixed-price, unrestricted invitation for bid procurement competed under FAR Part 14 and Solicitation Number W912WJ20B0006. The estimated cost for the brand-name materials is $210,000.

3. DESCRIPTION OF SUPPLIES/SERVICES

The New Hampshire Air National Guard (NHANG) requires an integrated base-wide fire alarm system. This project will include installation of new fire alarm system panels in 22 buildings.

The new fire alarm system panels will be required to report by radio transmission to an existing Central Reporting Station, which has been specified to be a Monaco D-21 Central Receiving System. In addition, new fire alarm control panels are required to be addressable, meaning the location of the device that triggers an alarm must be transmitted to the Central Reporting Station.

The total cost for the purchase of Monaco panels for this project is estimated to be $210,000 covering seventeen MAAP-X type panels and five BT-XM type panels.

4. AUTHORITY CITED

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. In accordance with FAR 6.302- 1(c), the Contracting Officer will specify that all offerors be required to procure only the cited brand-name product.

5. REASON FOR AUTHORITY CITED

Background:

The project includes replacing non-compliant, non-addressable fire alarm control panels with addressable wireless control panels and transceivers with capability to report by radio transmission to a Monaco D-21 Central Receiving System.

The Monaco D-21 Central Receiving System is being installed under a Pease ANGB contract, W912TF- 19-F-5004, in the spring of 2020. Pease ANGB completed a J&A for that contract action under FAR 8.405-6, Limiting Sources. Fire alarm panels installed under the action described herein are required to be compatible with this Monaco D-21 Central Receiving System.

Justification:

The contractor installing the modernized fire protection system components will be required to purchase Monaco Enterprises panels in order to be fully compatible with a D-21 Central Receiving System and thereby meet the fire alarm modernization requirements at Pease. Starting in FY 20, Pease will be utilizing the Monaco D-21 fire alarm system to report alarm information to the Pease Fire Department.

The modernized system is required to transmit discrete information regarding the status of the system on a point by point basis directly to fire dispatch, with signals such as “Alarm, Manual Pull Station, Main Entrance.” The increased level of detail will result in more informed and faster response by the fire department. The panels are required to be Monaco to ensure full compatibility and functionality when transmitting to the D-21 Central Receiving System. Installation of equipment from non-Monaco manufacturers would limit the amount of detail provided by an alarm signal and may delay fire department response. Therefore, use of Monaco panels will provide an increased level of life safety and property protection and is essential to the Government’s requirements. There have recently been two approved J&A’s for Monaco systems for projects at Pease ANGB.

Impact:

If the J&A is not approved, then there is risk that the construction contractor will install an alternative fire alarm panel. Installing equipment from other manufacturers would limit the information transmitted to the Central Receiving Station and fire department. Incomplete information would result in a delayed fire department response and longer investigation times. The impact of these delays increases risk of loss of life and property damage.

6. EFFORTS TO OBTAIN COMPETITION

Market research was conducted, details of which are in the market research section of this document. None of these efforts have yielded additional potential sources for compatible FACP’s.

7. ACTIONS TO INCREASE COMPETITION

This procurement will be competed under FAR Part 14. The Monaco Fire Alarm Reporting system is available on the open market for purchase by all bidders. The requirement to purchase Monaco fire alarm system panels does not preclude a wide range of contractors from submitting a bid on this procurement. All bidders may bid on this procurement utilizing the Monaco fire alarm system panels.

8. MARKET RESEARCH

One of NAE’s A-E firms, Colby Company, LLC, (Colby) works on many projects at Pease ANGB including W912WJ-17-D-0001 W912WJ17F0159 as the Designer of Record. This project also required a J&A for Monaco products (J&A 19-02, approved 24 January 2019).

Colby confirmed on 9 January 2020 that Monaco is still the only system that can transmit discrete information regarding the status of the system on a point by point basis directly to the Pease ANGB fire dispatch. A Notice of Intent (NOI) for Sole Source Purchase of Monaco Panels was posted on August 14, 2019. The NOI was published for 15 days on the Federal Business Opportunities website. There were no responses to the NOI. Finally, there was one response to the NOI issued November 13, 2018 for J&A 19-02 for use Monaco products at Pease ANGB; however it did not address whether its proposed product could integrate and function compatibly with an existing Monaco reporting system.
