About this file

This document contains a justification for a sole source contract award and details of the related federal contract opportunity. The Defense Logistics Agency awarded an interim sole source contract to an unknown vendor for the continued support of 281 Multi-Functional Devices located throughout Germany. The previous contract expired on July 31, 2022 but the follow-on contract to replace the devices would not be installed until April 1, 2023 due to COVID-19 supply chain issues. The sole source contract was necessary to avoid a gap in device support and was awarded on October 31, 2022 for an unknown amount to provide services until the new devices under contract SP7000-22-P-0015 can be installed. The sole source justification cites only one responsible source being able to meet the agency's requirements within the necessary timeframe.

IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER

THAN FULL AND OPEN COMPETITION:

The Statutory authority permitting other than full and open competition is Title 10,U.S.C. 2304 (c) (1) as implemented by the Federal Acquisition Regulation 6.302-1(a) (2)(iii)(B) –Only one responsible source and no other supplies or services will satisfy agency requirements.

DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES

USE OF THE CITED AUTHORITY:

DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:

Market research indicates that an adequate competition pool exists for requirements of this type. The contract will only be in place for up to 5 months to account for the time needed to install the MFDs on the follow-on contract.

DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT REPRESENTS THE BEST

VALUE TO THE GOVERNMENT BASED ON RECOMMENDED ACTION:

As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable by comparison of the proposed price to historical pricing for Germany.

DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS

NOT CONDUCTED:

Market research indicates that an adequate competition pool exists for requirements of this type (see Items 6 & 9 for further information) if sufficient delivery time is available.

This sole source contract shall only be in place long enough to provide support until the new MFDs contracted for on SP7000-22-P-0015, can be installed.

I have reviewed and concur with this justification.
