About this file

This is a Justification and Approval (J&A) document for the use of other than full and open competition for a sole-source contract award.

The Naval Facilities Engineering Systems Command Southeast (NAVFAC SE) seeks to award a sole-source contract to EMR, Inc. for continued maintenance of temporary hangar facilities supporting the TH-73A Advanced Helicopter Training System (AHTS) program at Naval Air Station (NAS) Whiting Field, Florida. The estimated contract value is $3,000,000.00 over three years (FY26-29), consisting of a $1,000,000.00 base award for Year 1 maintenance and two $1,000,000.00 options for Years 2 and 3. The requirement involves maintaining on-site temporary hangers and support facilities that are critical to the maintenance operations for the new TH-73A helicopter airframe.

The justification for sole-source procurement is based on 10 U.S.C. 3204(a)(1), citing substantial duplication of cost and unacceptable delays. EMR, Inc. currently operates fully functional temporary facilities at the location. Competitive procurement would require demobilization costs to remove existing structures and new contractor mobilization costs for site preparation, engineering, manufacturing, transportation, and construction of replacement facilities—estimated costs substantially exceeding $3,000,000.00 in duplicative expenses. Additionally, a competitive procurement would introduce 9-18 months of delays for procurement, manufacturing, and installation, creating a critical gap in maintenance capability that would disrupt the AHTS training mission, compromise pilot training pipelines, and prevent proper maintenance of TH-73A airframes. A sources sought notice was issued on January 22, 2026, with four responses received, but no vendor indicated capability to meet the April 1, 2026 deadline. The contracting officer determined fair and reasonable cost based on historical pricing analysis. The document includes certifications from the requirements cognizant, legal counsel, contracting officer, and ECHELON IV Chief of Contracting, with final approval from the Commanding Officer of NAVFAC SE.
