DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND SOUTHEAST
JACKSONVILLE, FL 32212-0030
J&A N69450-25-0457
JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Department of the Navy, Naval Facilities Engineering Systems Command Southeast (NAVFAC SE), Jacksonville, Florida.
2. Description of the Action Being Approved.
Approval is sought to increase the contract maximum or not-to-exceed (NTE) amount for Contract N69450-20-D-0052, Professional Architect and Engineering (A/E) Services Indefinite Delivery Indefinite Quantity (IDIQ), by $15,000,000, thereby increasing the total NTE amount from $60,000,000 to $75,000,000. This action will not extend the ordering period.
The IDIQ was solicited as an unrestricted procurement under full and open competition. It was awarded to the AECOM, Los Angeles, CA on 24 September 2020. The contract is for a period of five (5) years, with of the ordering period expiring on 23 September 2025.
3. Description of Supplies/Services.
NAVFAC SE procured an A/E IDIQ contract for the Southeast Area of Responsibility (AOR), providing professional design services to include labor, travel and other direct costs necessary to perform projects in the $200,000 - $30,000,000 task order range. Although this contract is primarily for use within the Southeast AOR, the contract AOR can extend beyond Southeast if necessary.
4. Statutory Authority Permitting Other and Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1 –Only one responsible source and no other services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Based upon the awards already made under this contract, pending PCAS options, planned future requirements and a planned reserve amount, it is determined that an additional $15,000,000 in capacity is required to meet all current and future FY 2025 requirements.
Without the unplanned MILCON project enhanced PCAS services, the current contract capacity of $60,000,000 would have been sufficient to meet all planned requirements through
FY 2025.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The A/E IDIQ was competed as an unrestricted solicitation. In accordance with Department of Defense FAR Supplement PGI 206.302-1, only one responsible source and no other services will satisfy agency requirements, a sources sought notification was posted to SAM.gov on 2 August 2024. Two firms responded to the notification and neither were determined to be qualified to perform the work. In accordance with FAR 6.305, the approved J&A will be posted on beta.SAM.gov within 14 days after award of the contract modification.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
NAVFAC SE will pursue/investigate business opportunities other than the sole-source as requirements are realized. NAVFAC SE is currently in rate negotiations for an additional five
(5) A/E IDIQ instruments with a total not-to-exceed value of $495,000.000 for award in FY25.
