J&A: N69450-20-0329
29 SEP 2020
1. Contracting Activity: The agency is the Department of the Navy. The contracting activity is Naval Facilities Engineering Command Southeast (NAVFAC SE). The contracting office is Public Works Department (PWD), Facilities Engineering and Acquisition Division (PWD FEAD), Naval Air Station (NAS), Pensacola, Florida. 2. Description of the Action Being Approved: On 16 September 2020, Hurricane Sally made landfall as a Category 2 Hurricane, inflicting significant damage to the facilities and infrastructure on NAS Pensacola. NAVFAC SE, proposes to continue initial, immediate rapid stabilization for Hurricane Sally restoration/sustainment/recovery requirements on a sole source basis with CH2M HILL/Jacobs Engineering (Jacobs), 9189 Jamaica Street, Englewood, Colorado 80112-5946. The contract vehicle will be a firm-fixed-price task order against the Jacobs Global Contingency Construction Contract (GCCC) vehicle N62470-19-D-8024. 3. Description of Supplies/Services: The scope of the requirement is immediate Hurricane Sally restoration/sustainment and clean-up recovery actions on board Naval Air Station (NAS) Pensacola, FL. Specific elements of work include Roofing/Seal Building Envelope; Rip Out/Tear Out; Mold Remediation; Vegetation/Tree Clearing/Chipping; Waste/Debris collection, removal and disposal; traffic management; security fencing; and on site contractor management and subcontractor oversight. The effort is oriented to the priority one most mission critical facilities (approximately 375 of the more than 700 facilities to be surveyed and assessed). The estimated cost for this action is $30,000,000.00. The instant one time action equates to a 6.8% of the current recovery estimate of up to $443,000,000.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(2) as implemented by FAR 6.302-2, Unusual and Compelling Urgency. The United States would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. 5. Rationale Justifying Use of Cited Statutory Authority: It is critical to restore these facilities in the most expeditious manner so that the mission is not impacted. NAS Pensacola’s national security mission supports operational and readiness requirements including: primary initial training installation for all U.S. Navy, Marine Corps, Coast Guard officers pursuing designation as naval aviators and flight officers; the advanced training installation for most naval flight officers, and as the home base of the U.S. Navy flight demonstration Squadron, the precision flying team known as the Blue Angels; is also known as the “cradle of naval aviation”; hosts the Naval Education and Training Command (NETC) and the Naval Aerospace Medical Institute (NAMI, the latter of which provides training for all Naval flight surgeons, aviation physiologist, and aerospace experimental psychologists); other NATO/Allied/coalition aviator partners train on the installation; and NAS Pensacola is the home to Naval Air Technical Training Center (NATTC) which provides technical training schools for nearly all enlisted aircraft maintenance and enlisted aircrew specialties in the U.S. Navy, Marine Corps and Coast Guard. The station is crucial to the nation’s defense. It is imperative to restore these facilities in the most expeditious manner so that the mission is not negatively impacted further. Jacobs is currently mobilized on NAS Pensacola performing restoration of the mission critical facilitates under a $14,247,534.00 task order. This action was approved due to the fact that Jacobs was mobilized on the Station doing rapid renovation of the mission critical facilities, Buildings 624, 625 and 633, for Naval Education and Training Security Assistance Field Activity (NETSAFA), Naval Aviation Schools Command (NASC), and the School of Aviation Safety (SAS). In engaging Jacobs, the Government realizes immediate response and technical expertise specifically aligned to NAS Pensacola, which would otherwise be significantly delayed via traditional competitive procedures. Additional areas of consideration: Jacobs is currently performing successfully on Bldg. 633, and has gained significant knowledge through the planning and repair processes of NAS Pensacola. This knowledge will be valuable to the overall response effort and quality of the final products resulting from disaster recovery. Jacobs is one of the six GCCC holders, the precise instrument to effect superior, rapid response to weather events. Failure to immediately begin disaster recovery will result in extended operational down time and additional cost to the activity. Additional time and cost would be required in order for another contractor to gain the same knowledge of the current site conditions. A different contractor would require extended time to prepare a response plan and overcome logistical challenges in gaining access to the location. Jacobs is familiar with logistics challenges and current operational conditions. Significant storm damage was realized as a result of Hurricane Sally. Facility deterioration is compounded for every day stabilization and repairs are not done. Routine weather events exponentially increase further damages to the exposed facilities without an immediate, continued response. Failure to implement immediate disaster recovery with Jacobs will result in extended operational down time and additional cost to the activity. Additional time and cost would be required in order for another contractor to gain the same knowledge of the damage assessment and current site conditions. Additionally, a different contractor would require extended time to prepare a response plan and overcome logistical challenges in gaining access to the location. Jacobs is preparing a response plan with the PWD/FEAD jointly, and is familiar with the current operational conditions. Additionally, Jacobs has completed numerous hurricane recovery projects for NAVFAC. Rapid response is critical to assist the Navy in restoring NAS Pensacola to full mission capability (FMC). The mission impact on the installation being taken offline greatly affects the training pipeline for Training U. S. military aviators. Utilization of the proposed contract task order requirements allows the work to be accomplished in the most efficient mode immediately available. NAVFAC gains efficiency by accomplishing multiple requirements (identified in Paragraph 3) at a rapid pace with a single contractor, and contract instrument. Jacobs has extensive competition and small business subcontracting requirements which aides in ensuring small business participation. The COVID-19 environment has a significant impact on mission readiness at NAS Pensacola. Health and safety concerns have severely limited the pool of potential contractors available to the installation to execute work. Restriction of Motion (ROM) requirements apply additional negative impacts (delay and subcontracting opportunities). Jacobs is currently under contract on NAS Pensacola, and has employees and a pool of subcontractors already established on the installation, and in the local to the community. Quarantine requirements apply additional negative impacts to mobilizing new contractors to the site. Thus, Jacobs is in position to contribute to immediate recovery efforts. In order to avoid recovery delays due to conflicts in coordination and schedules, which could lead to excess costs and associated delays, it is in the Government’s best interest not to compete and separate these initial sustainment requirements. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: Upon approval of this J&A, the proposed action will be synopsized on the Government-wide Point of Entry (GPE) as required by FAR 5.201. No additional market research beyond the qualifications of the GCC MAC was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company(s) other than Jacobs. The GCC MAC was competed utilizing full and open competition and CH2M-Hill Constructors, Inc. Jacobs Engineering was selected as one of the MAC holders in a competitive environment. 7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government for the supplies and services covered by this J&A will be fair and reasonable, and based upon the offeror’s certified cost and pricing data. 8. Actions to Remove Barriers to Future Competition: This action is a unique one-time procurement due to an unforeseeable event. Critical mission essential initial recovery sustainment efforts are urgently required. In routine procurement environments, NAVFAC SE will take appropriate actions that promote competition and small business goals that are in the best interests of the agency, stakeholders, and expenditure of tax payer dollars.
