About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the procurement of a Federal Signal Mass Notification Remote Terminal Unit UVRI-B UltraVoice for Contract N6274219D1328_N6274220F9924, MCON Project P-491 EOD Compound Facilities at Naval Base Guam. The J&A cites the statutory authority under 10 U.S.C. 3204(a)(1) and FAR 6.302-1(c)(1) as only one responsible source, Federal Signal, can provide the required communications "bridge" between the wide-area outdoor and indoor mass notification systems. The unit is essential to meet UFC standards, performance specifications, and obtain Authority to Operate accreditation. Replacing existing Federal Signal components would incur over $3M in substantial duplication costs. The estimated cost for the Federal Signal unit is $24,800, comprising 0.0005% of the total $50.45M project. The contracting officer has determined the cost is fair and reasonable. Market research indicated no other known manufacturers of a compatible unit.

JUSTIFICATION AND APPROVAL FOR

OTHER THAN FULL AND OPEN COMPETITION

FOR ONLY ONE RESPONSIBLE SOURCE

N6274219D1328_N6274220F9924 MCON PROJECT P-491 EOD Compound Facilities Naval

Base Guam

J&A No. JA20231208-02

1. CONTRACTING ACTIVITY.

Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC), Facilities Engineering and Acquisition Division (FEAD), Public Works Department, Naval Base Guam

2. Description of the Action Being Approved.

Request approval to include proprietary specifications to specify by brand name, Federal Signal Mass Notification Remote Terminal Unit UVRI-B UltraVoice® for contract N6274219D1328_N6274220F9924 MCON PROJECT P-491 EOD Compound Facilities Naval Base Guam. The brand name specification is essential to the activity’s requirements, thereby precluding consideration of a product manufactured by any other company.

The estimated cost for the procurement of the Federal Signal Mass Notification Remote Terminal Unit UVRI-B Ultra Voice® is $24,800.00, which comprises 0.0005% of the total project amount of $50.45M. This J&A covers only the portion of the acquisition which is brand name, the Federal Signal Mass Notification Remote Terminal Unit UVRI-B Ultra Voice®.

3. Description of supplies/services.

As part of the construction project requirements, the Federal Signal Mass Notification Remote Terminal Unit UVRI-B UltraVoice® will be installed at the Consolidated Operation Facility, Maintenance Facility, and Multi-Purpose/Training Facility. The purpose/function of the proposed equipment is to receive transmission signals from the Mass Notification System and disseminate internal broadcasting messaging to building occupants in the event of an emergency to protect life by instructing people of the necessary and appropriate action.

The estimated cost for the equipment is $24,800.00 which comprises 0.0005% of the total project cost of $50.45M. The resultant modification for this action will be funded with FY20 MILCON project funds.

4. Statutory Authority Permitting Other Than Full and Open Competition:

This J&A is in accordance with the statutory authority, 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Award to another source would result in substantial duplication cost to the Government that is not expected to be recovered by competition.

The Federal Signal Mass Notification Remote Terminal Unit UVRI-B UltraVoice® provides the required communication "bridge" between a Wide Area (Outdoor) and indoor mass notification systems (MNS). This "bridge", provided by the UVRI-B UltraVoice® also provides required interface with each of its associated building's fire alarm panel and designed to provide remote control status and monitoring. Features include:

CSFM Approved

The requirements of the installation and operational requirements of a MNS is included in UFC 4-021-01 Design and O&M: Mass Notification Systems. Other military installations throughout the various bases on Guam have already had (or is in the process of having) their systems retrofitted via an Installation Design Plan (IDP) by Naval Information Warfare Center (NIWC) to replace legacy systems with the Federal Signal brand that brings the base MNS up to the current Unified Facilities Criteria (UFC) standards, Authority to Operate (ATO), accreditation specifications, and naval facilities performance standards. In addition to the interface features and operational characteristics requirements, Federal Signal currently is the only system to meet all three requirements for NAVFAC Antiterrorism and Force Protection (ATFP); UFCs, Performance Specifications (PSPEC), and have an ATO.

The Wide Area MNS and individual building indoor systems will be tied into the exterior portion of the system which currently will receive transmitted signals from the Joint Region Marianas (JRM) Operations Center and also the JRM Region Dispatch Center, both located in JRM HQs, (Bldg 200) at Nimitz Hill.

If another source other than FedSig component is procured, replacement of required compatible equipment at the communication hub (JRM Operations Center, JRM RDC and Emergency Operation Centers) including existing installations facilities that are already fitted with FedSig Remote Terminal Units in-place, would need to be replaced and/or retrofitted at a cost in excess of $3M. This cost will result in substantial duplication cost to the Government that is not expected to be recovered by competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The following market research was conducted for Class J&A No. 20-017 approved on 8 June 2020, issued for 56 specific Defense Policy Realignment Initiative (DPRI) Guam projects targeted for award from FY20-FY25. While the P-491 project was not named in this class J&A, the same rationale is the basis for the P491 Brand Name J&A. On 23 April 2020, an announcement was published on the beta System for Award Management (SAM) website in accordance with DFARS 206.302-1 to identify other potential sources of supply that can provide the Mass Notification Remote Terminal Unit with equal performance and listing/approval requirements as the Federal Signal Mass Notification Remote Terminal Unit UVRI-B Ultra Voice®. No responses were received in response to this announcement. Therefore, there are no other known manufacturers of the Mass Notification Remote Terminal Unit other than the Federal Signal Mass Notification Remote Terminal Unit UVRI-B Ultra Voice® that is compatible with the existing system.

According to NAVFAC Pacific Fire Protection Engineer, a Federal Signal brand transceiver must be procured because Federal Signal Systems has received NAVFAC HQ authorization to operate (ATO) for cybersecurity. Accordingly, use of any other brand require the same rigor in obtaining ATO. Further, system compatibility is an issue as the Federal Signal System components are UL listed to perform reliably.

7. Determination of fair and reasonable cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions taken to remove barriers to competition.

Although the utilization of a brand name in this project is indicated by this J&A, each future project that includes Mass Notification Remote Terminal Unit UVRI-B UltraVoice® will conduct the same market survey to ascertain the availability of new technology that may provide for other sources to meet the Government's needs. Should any other potential sources of supply for compatible Indoor Remote Terminal Unit be submitted during the source selection process, the Government will consider them as applicable.
