Sole Source Justification and Approval Under FAR 13.501
1. Contracting Activity: Army Contracting Command Aberdeen Proving Ground (ACC- APG), 6565 Surveillance Loop, Building 6001, APG, MD 21005-3013.
2. Description of Action: The US Army Public Health Center (APHC) requires the purchase of delivery and installation of Admin Metasys Building Upgrades on 5 building automation systems in 5 different administrative buildings APHC occupies. The Government projects award for September 2022 and fiscal year 2022 Army funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: Provide and install 5 building automation systems in 5 different administrative buildings APHC occupies. These systems shall provide HVAC controls, monitoring capabilities, and trending data to the following buildings: E- 1570, E-1675, E-1677, E-1930, and E-5158. All buildings HVAC systems will be upgraded with variable valves and dampers to include outside air dampers, steam valves, hot water valves, and cooling valves. The systems will also provide statuses of supply fans, steam pressure, discharge air temperature, hot water temperature, and damper positions.
Total Estimated dollar value for this requirement is
4. Authority Cited: 41 United States Code 1901 as implemented in Federal Acquisition Regulation 13.501(a)(1)(ii), sole source Metasys under the authority of the simplified procedures for certain commercial items.
5. Reason for Authority Cited: Johnson Controls Metasys is proprietary in nature and is the only building automation system that is allowed on the Aberdeen Proving Ground Network according to the NEC. APHC Facilities have antiquated Metasys systems in them currently and were required to be removed due to INFOSEC requirements. E- 5158 specifically has a system that operates on a modem and that is no longer supported. In the interim we have supplied these systems with residential HVAC controls and these controls do not modulate air space requirements to ASHRAE indoor air quality standards. These new controllers will also be up to INFOSEC requirements and will be allowed to operate on the network.
APHC has been utilizing Johnson Controls Metasys for the past 10 years and no other system has come out that has been approved by the NEC to be allowed on the network.
If this is unable to be provided APHC will not be able to have HVAC controls on these buildings and allow for call-outs in the event of failures. APHC will also not be able to monitor systems and ensure they maintain ASHRAE standards.

6. Efforts to Obtain Competition: The Contracting Officer will publish the notices required by FAR 5.201 and any bids or proposals received shall be considered. Based on the information provided outlined in Sections 5 (Reason for Authority Cited) and Section 8 (Market Research), this is a sole source requirement and effective competition is not feasible. This is a proprietary, COTS product line. As required by FAR Subpart 5.2, a notice of intent to award sole source to Johnson Controls will be posted in SAM.gov webpage.
7. Actions to Increase Competition: APHC will continue to research and make every effort to use compatible supplies that will not limit to brand name only, but instead compete these requirements to the maximum extent possible, and within current policy.
Future efforts will include contacting various industry partners, manufacturers, distributors, etc. Ensuring the widest dissemination of opportunity among these entities will maximize the possibility of competition and cost savings for the Government.
8. Market Research:

9. Interested Sources: To date, no other sources have written to express an interest. The notices required by FAR 5.201 shall be or have been published, and that any bids or proposals received shall be considered.
10. Other Facts: MRICD utilized the Schneider Building Automation system and that system was unable to be connected to the network and was required to be a stand-alone system. This required MRICD personnel to be on site 24/7/365 to attend to any alarm that arises from the system.
