Justification and Approval (J&A) For
Other Than Full and Open Competition
Acquisition Plan Action ID:
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 07, in support of
Carl Vinson VA Medical Center located at 1826 Veterans Blvd., Dublin GA 31021. Purchase request number .
2. Nature and/or Description of the Action Being Approved: The proposed action is to award a new firm-fixed price purchase order for medical air compressor system replacement services at the Carl Vinson VA Medical Center.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Carl Vinson VA
Medical Center (CVVAMC) requires a new medical compressed air system as the current equipment is beginning to fail on humidity requirements. The Contractor shall provide a new medical compressed air system; all labor, supervision, tools, and material required to remove and dispose of the existing system and install the new air system. This is a one-time procurement with a total estimated value of . All services must be complete within 60 days of contract award.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.
Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR
819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:
(X) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Pursuant to 38 U.S.C.
8127(c), Contracting Officers may award sole source contracts to service-disabled veteran-owned small businesses (SDVOSBs) in accordance Veterans Affairs Acquisition Regulation (VAAR) 819.7008 when the criteria at VAAR 819.7003 are met. The market research and analysis summarized in paragraph 8 below, show (a) Atlantic First Industries Corporation “AFIC” is a certified SDVOSB; (b) AFIC meets the eligibility requirements at VAAR 819.7003; and (c) the Contracting Officer (CO) anticipates the total cost of the procurement will be fair and reasonable. VAAR 819.7008 further states that a determination that only one SDVOSB can meet the requirement is not required, and the CO’s determination to make a sole source award is a business decision wholly within the discretion of the CO.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies: Due to the urgency to replace the medical compressed air system, minimum efforts were made to pursue full and open competition. Initial market research conducted identified three vendors, including one SDVOSB, that

Effective Date: 11/15/2024 are interested and capable of supporting this requirement. Additional market research was conducted in the Federal Procurement Data System (FPDS) to identify possible vendors among awardees for similar projects. The search returned multiple results but only (1) one award was to another SDVOSB for the same type of equipment and service as this requirement. However, based on an analysis of informal estimates received during market research and the Government’s IGCE, the CO determined that a sole source award is in the best interest of the Government for timely replacement of the system. Pursuant to 38 U.S.C. 8127(c), Contracting Officers may award sole source contracts to service-disabled veteran-owned small businesses (SDVOSBs) in accordance Veterans Affairs Acquisition Regulation (VAAR) 819.7008 when the criteria at VAAR 819.7003 are met. VAAR 819.7008 further states that a determination that only one SDVOSB can meet the requirement is not required. The Federal Procurement Data System (FPDS) was used to identify possible vendors among awardees for similar projects.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Three informal estimates were submitted from vendors interested and capable of supporting this requirement. The highest estimate was 10% above the second lowest price.
However, there was only a 3.5% difference between the two lowest estimates suggesting the two lower rates are both fair and reasonable. Based on this analysis, the CO has determined that the anticipated cost of the award will be made at a price that is fair and reasonable.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The facility used personal knowledge and information from industry to identify (3) vendors that were interested and capable of supporting this requirement.
The suggested vendors were cross referenced in the Small Business Administration’s (SBA) Dynamic Small Business Search (DSBS) database and SAM.gov where it was determined that (1) vendor is an SDVOSB, (1) vendor is a small business (SB), and the third vendor is not registered in DSBS or SAM.
Additional market research was conducted in FPDS to identify possible vendors among awardees for similar projects, where only (1) one award was to another SDVOSB for the same type of equipment and service as this requirement. However, due to the priority of this requirement and the capability of an existing SDVOSB to provide the requested equipment and services at a price that is expected to be fair and reasonable, the Contracting Officer determined that no additional sources would be sought.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. Pursuant to 38 U.S.C. 8127(c), Contracting Officers may award sole source contracts to service-disabled veteran-owned small businesses (SDVOSBs) in accordance Veterans Affairs Acquisition Regulation (VAAR)
819.7008 when the criteria at VAAR 819.7003 are met. VAAR 819.7008 further states that a determination that only one SDVOSB can meet the requirement is not required.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Atlantic First Industries Corporation (SDVOSB); Artec Environmental (SB); and Evergreen Medical Services (Large/not registered in SAM).
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Government will continue to conduct market research for sources interested and capable of supporting the Government’s needs in an effort to maximize competition when it is in the

Government’s best interest to do so. The Government will also ensure awards are made at prices that are fair and reasonable and offers the best value to the Government.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
