DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND, MID-ATLANTIC

9324 VIRGINIA AVENUE

NORFOLK, VIRGINIA 23511-3095

J&A No. ML-21-06

19 January 2021

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Department of the Navy, Naval Facilities Engineering Systems Command Mid-Atlantic (NAVFAC MIDLANT), Facilities Engineering Acquisition Division (FEAD) Marine Corps Air Station (MCAS) Cherry Point, North Carolina.

2. Description of Action Being Approved.

Approval is sought to increase the contract maximum not-to-exceed (NTE) amount on Architect and Engineer (A&E) Contract N40085-17-D-0008 for civil engineering and design services at MCAS Cherry Point and Marine Corps Base (MCB) Camp Lejeune, North Carolina by REDACTED from REDACTED to REDACTED.

3. Description of Supplies/Services.

NAVFAC MIDLANT procured a small business set-aside Indefinite Delivery Indefinite Quantity (IDIQ), Firm-Fixed Price contract for A&E civil engineering and design services for projects located primarily in eastern North Carolina including MCAS Cherry Point and MCB Camp Lejeune and outlying areas such as Bogue, Atlantic, Piney Island and MCAS New River, including administrative buildings, industrial type facilities, warehouses and storage buildings, maintenance facilities, communication buildings and structures, training/education facilities, personnel support type facilities, military tactical facilities, and similar type facilities. The contract was awarded on 26 September 2017 to Neser, Roomsburg & Workman, PC.

The contract has a one-year base period and four one-year option periods and is currently in the third option period. The current contract completion date is 25 September 2021 with a prospective option period that could extend the ordering period to 25 September 2022.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(2), as implemented by FAR 6.302-2, Unusual and Compelling Urgency.

5. Rationale Justifying Use of Cited Statutory Authority.

There were critical unexpected repair projects for Marine Corps Installations East at MCAS Cherry Point that will require additional contract capacity as a result of Hurricane Florence, which made landfall in Southeastern North Carolina, where MCAS Cherry Point is located, on September 14, 2018. MCAS Cherry Point experienced significant damage to its facilities as a result of Hurricane Florence, and a large amount of building repairs were required in order for the facilities to be mission-ready. Additional contract capacity is needed to supplement the design and engineering staff of the FEAD (Design Section), and to assist ROICC MCB Camp Lejeune in the development of Facilities, Sustainment, Restoration and Modernization (FSRM) renovation projects tied to the Hurricane Florence recovery effort and the regular FSRM program.

The IDIQ was advertised and awarded with an aggregate NTE amount of REDACTED.

Currently, there is not sufficient contract capacity to support the amount of repairs required and the unforeseen project costs. Below is a list of the required design projects and estimated costs:

PCAS for other projects REDACTED

Competing these contracts on a standalone basis is not in the best interest of the Government as, in accordance with FAR 6.302-2(b)(2), delay in award of these contracts would result in serious injury, financial or other, to the Navy and its mission. The administrative effort required to award new individual contracts is not cost effective and cannot be completed timely which impacts the Government’s ability to meet mission essential requirements.

The IDIQ contract was competed using full and open competition at the time of contract award.

The expectation is that utilizing full and open competition for the required projects as standalone procurements would not garner any significant savings beyond what can be provided on the current contract, and would result in substantial duplication of costs if the Government is required to find new contractors to perform the work. It has been determined that Neser, Roomsburg & Workman, PC is capable of performing the work and is familiar with MCAS Cherry Point and the types of work to be performed, which will allow for greater efficiencies in pricing and performance of the work.

Prior to this unexpected work, the acquisition planning had just begun for the follow-on contract vehicle. A new IDIQ for Architecture and Engineering Services for civil engineering and design services within North Carolina will be solicited and typically requires at least twelve to eighteen months of procurement lead time. The new IDIQ will not be awarded in time to provide the capacity to accommodate these new requirements.

6. Description of Efforts Made to Solicit Offers from as many Offerors as Practicable.

Due to the urgency and the unexpected workload, it is not practical or in the best interest of the Government to solicit additional sources for the additional work, but rather continue to use Neser, Roomsburg& Workman, PC under the current IDIQ contract.

7. Determination of Fair and Reasonable Costs.

The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable. All task orders on this contract to date have been determined to be fair and reasonable in accordance with FAR 15.404-1, Proposal Analysis Techniques, through comparison to the Government Estimate. All future work will continue to be evaluated in accordance with FAR 15.404-1.

8. Actions to Remove Barriers to Future Competition.

Procurement planning is currently being performed for a new IDIQ for A&E services for civil engineering and design services within North Carolina AOR, with a projected award timeframe of 2022. New projects that meet the requirements based on scope, location and dollar value will be competed among the new design contractor.
