About this file
This is a Justification and Approval (J&A) document for other than full and open competition issued by the Defense Logistics Agency (DLA) Contracting Services Office in Philadelphia for the procurement of Kepware Suite software and maintenance services.
The requiring activity is DLA Information Operations (J6) located at Fort Belvoir, Virginia. DLA seeks to procure subscription-based software licensing to support the J62BG Hemi Application on an annual basis, which will include technical and product support throughout the enterprise. The total estimated dollar value for the 12-month base period is redacted in the document. The procurement is anticipated to be awarded as a fixed-price contract. The contracting officer, Isaac Chapman, determined that pricing will be fair and reasonable based on FAR 15.404-1 price analysis techniques, including comparison of proposed prices, competitive published price lists, and market research data.
The justification for sole-source procurement is based on 10 U.S.C. 2304(a)(1), as implemented by FAR 6.302-1, citing that only one responsible source—PTC/Velotic—can meet the government's requirements. The Kepware Suite software is essential to DLA's IT operations and provides critical functionality including communications with multiple protocol networks (GE Intelligent Platforms SRTP Ethernet, SNP Serial, CCM, and EGD), OPC data access to Modbus-compatible devices, and support for Allen-Bradley equipment used in manufacturing processes. Market research identified PTC/Velotic as the sole manufacturer and CoAspire as the only authorized reseller available to quote; however, the requirement will be synopsized on SAM.gov to solicit offers from all authorized resellers. Using non-authorized resellers would void warranties and would not be recognized by PTC/Velotic.

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.
This Justification approval for other than full and open competition authorizes and approves the procurement of sole-sourced Kepware Suite software and maintenance for J62B HEMI Energy application. The placement of a fixed price contract is anticipated.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS/ESTIMATED DOLLAR AMOUNT:
DLA has a requirement to obtain subscription-based software licensing to support J62BG Hemi Application. This will be an annual subscription which will include technical and product support throughout the Enterprise.
The total estimated dollar value for the 12-month base period is $.
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION:
DLA Contracting Services Office SUBJECT: J&A –Kepware Suite
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(a)(1), as implemented by FAR 6.302-1 “Only one Responsible Source and no other supplies or services will satisfy agency requirements.” The PTC/Velotic Kepware brand name is essential to the Government’s requirements, and market research indicates that other companies’ similar products and services do not meet, or cannot be modified to meet, the agency’s needs. The required Kepware software upgrade and maintenance provides critical support to DLA’s enterprise Information Technology (IT) operations and is necessary to support DLA’s Hemi Application environment. As such, it is essential to the Government’s requirements, as explained in greater detail below. Brand name PTC/Velotic Kepware products and services are essential to this Government requirement. No other companies’ similar products can provide the compatibility required to support DLA’s Hemi Application. Similarly, no other company can provide the highly specialized maintenance services necessary to support the proprietary PTC/Velotic products currently in use within DLA. Accordingly, this Agency requirement can only be met by PTC/Velotic and its certified resellers.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF CITED
AUTHORITY:
The Kepware Suite licenses and maintenance will allow J62BG Hemi Application to maintain current active status licensed software. This software is name brand specific and only authorized OEM is PTC/Velotic. This will be an annual subscription which will include technical and product support throughout the Enterprise. Kepware software licenses will allow DLA to access communications with multiple protocol networks, including GE Intelligent Platforms (GE Fanuc) SRTP Ethernet, SNP Serial, CCM, and EGD. It will also provide application access, including OPC data to Modbus-compatible devices, enabling users to easily configure fast and reliable Modbus connections. The Modbus Suite supports multiple Modbus protocols (including TCP, RTU, ASCII, and more). The Allen-Bradley Suite is used primarily in the process, assembly, robotics, packaging, and material handling phases of the manufacturing process.
In accordance with FAR 6.302-1, brand name Kepware subscription software from PTC/Velotic as a sole source is essential to the Government’s requirement because the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy the agency’s requirements.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
Market research was conducted via Open Market. PTC/Velotic is the only manufacturer that provides Kepware Suite software, and currently CoAspire is the only authorized reseller that was available to quote on this requirement. The requirement however will be synopsized to solicit within SAM.gov. All authorized resellers will be given an opportunity to submit an offer.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR l 5.404- l(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS:
Market research was conducted via the manufacturer’s website and other commercially available websites. The OEM PTC/Velotic, concluded the reseller CoAspire was the only source capable of providing Kepware Suite software to the government. DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government as a continuing effort within DLA.
DLA always uses a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition. No other sources have demonstrated the capability necessary to provide the subscription software and software subscription support, at this time.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION:
PTC/Velotic, is the only vendor authorized to provide proprietary Kepware subscription software. Utilizing a non-PTC/Velotic authorized reseller would void warranties on the Kepware Suite subscription software and would not be recognized by PTC/Velotic.
