DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING AND EXPEDITIONARY WARFARE CENTER

1000 23RD AVENUE

PORT HUENEME CA 93043-4301

IN REPLY REFER TO

JA-20-005

JUSTIFICATION AND APPROVAL

FOR LIMITED USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The requiring activity is the Naval Facilities Engineering Command (NAVFAC), Engineering and Expeditionary Warfare Center’s (EXWC) Expeditionary Program Office (ExPO), Port Hueneme, California. The contracting activity is NAVFAC EXWC Acquisition, Port Hueneme, CA.

2. Description of the Action Being Approved.

Approval is sought to obtain authority to use other than full and open competition to issue a modification for a six-month bridge extension to contract N39430-15-D-1603, Lifecycle Sustainment and Integrated Product Support (IPS). The contract ordering period ends 17 June 2019. No additional contract ceiling (dollars) are requested. This extension will meet anticipated needs and will allow adequate time to award a follow-on contract.

3. Description of Supplies/Services.

The IPS contract is a firm-fixed price, indefinite delivery, indefinite quantity (IDIQ) contract that was awarded as a small business set-aside to one contractor, Synectic Solutions, Incorporated.

The purpose of this contract is to obtain Lifecycle Sustainment and Integrated Product Support (IPS) services for the following categories:

(1) Product Support Management

(2) Design Interface Standardization and interoperability

(3) Sustaining Engineering

(4) Supply Support

(5) Maintenance Planning and Management

(6) Packaging, Handling, Storage, and Transportation

(7) Technical Data

(8) Configuration Management

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. Section 3304(c)(1) and (d)(1)(B), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, and 10 U.S.C.

2304(c) (2), as implemented by FAR 6.302-2. FAR 6.302-1 permits other than full and open competition when only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

a. The original ordering period on the contract is June 18, 2015 through June 17, 2020.

Based on the current plan of actions and milestones for the follow-on ExBOSS contract, the estimated award date is 18 December 2020.

b. The procurement team originally planned on awarding the follow-on ExBOSS contract by June 2020. Executing the schedule for the June 2020 award was jeopardized when leadership within NAVFAC EXWC ExPO turned over during the command’s reorganization in July of 2019, and technical requirements had to be revisited and re-approved. Further, the NAVFAC EXWC implementation of Navy Enterprise Resource Planning (ERP) in October of 2019 exacerbated the delay due to the implementation of untested processes for transferring, approving, and routing funding resulting in unmitigated delays in changes to the complete procurement package process and Purchase Request submittal.

d. The IPS FY20 task orders are currently in process and are planned to be awarded prior to the expiration of the IPS option year 4 using existing contract capacity. There is a need however to have the contract remain in place through December 2020 for emerging requirements.

e. The current IPS contract provides Lifecycle Sustainment and Integrated Product Support (IPS) services considered unique due to the wide range and diversity of the equipment as well as specialized military modifications imposed upon the equipment. Without an adequate contract support vehicle in place, there would be an unacceptable risk of multiple NAVFAC Expeditionary Commands operational degradation and even loss of readiness. The standard procurement administrative lead-time for this procurement is 325 calendar days, and the additional 6-month extension is necessary to provide adequate readiness coverage.

f. The proposed six-month bridge action will provide NAVFAC with the necessary contract coverage for the end of the IPS contract in June 2020 through December 2020, at which time the Expeditionary Business Line Office Support Services (ExBOSS) Contract is expected to be in place. The six-month bridge will allow the Government adequate time to competitively award the follow-on contract and transition the work to the Seaport NXG contract. The bridge period should be sufficient to cover any delays caused by protests.

6. Description of Efforts Made to Solicit Offers from as Many Vendors as Practicable.

Since the incumbent contractor is the only source capable of providing the required services within the timeframes required, without a break or delay in services, no other offers for this proposed additional tasking have been solicited.

Sources Sought announcements have been issued IAW Navy Marine Corps Acquisition Regulation Supplement (NMCARS) part 5237. The results of the Sources Sought announcements indicate that ample competition exists within the small business community to meet the requirements for the follow-on contract. The contemplated bridge period will allow the Government adequate time to competitively award the follow-on contract via a small business set-aside. This J&A supports Navy projects that must be accomplished within the timeframes stated herein to avoid potentially severe impact to mission critical functions and operations.

This J&A supports Navy projects that must be accomplished within the timeframe stated herein to avoid likely severe impact to mission critical functions and operations.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by the J&A will be fair and reasonable with FAR Part 15. It is anticipated that all future task order awards will be determined fair and reasonable based on similar task orders that were awarded against the contract.

8. Actions to Remove Barriers to Future Competition.

A competitive follow-on contract is in process and will be awarded as soon as practicable. The follow-on contract will be a single award task order through SEAPORT NXG contract. It is anticipated that the task order will be awarded by 30 December 2020.
