Justification and Approval – JDA Software Maintenance

Source Selection Information – See FAR 2.102 & 3.104 For Official Use Only (FOUO) product of JDA Software Inc. No other firm can provide this brand name software, and no other brand name software maintenance is compatible with this brand name product due to the proprietary nature of the software. Only JDA Software Group Software Maintenance will support the JDA reporting license being purchased by DLA on this contract. Use of this brand name description in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product of another company.

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF CITED

AUTHORITY:

In 2011, JDA Software Group, Inc.’s software was chosen as the single, sole-source application for all planning and optimization functions for use in the DLA EBS. The application suite platform provides DLA integration or products, date compatibility/consistency, enterprise support for monitoring and sustainment. DLA has made significant financial investments in the JDA software and it is an integral component of the EBS Enterprise Software Suite. The DLA objectives of achieving cost savings and providing better performance for the same or better costs will be near impossible to attain without maintaining software compatibility in accordance with established agency standards. Continuing with the JDA software solution provides DLA with the opportunity to forecast customer demand, partner with industry to replenish inventory and position stock within the DLA Distribution Network proactively to prevent backorders and mission degradation to the War-Fighter.

The software is proprietary to JDA Software Group, Inc., and no other firm’s product or maintenance support is compatible with, and cannot be modified to be compatible with, the existing JDA Demand Management and Reporting software. JDA Software Group, Inc., issued the software licenses and has not authorized any other source to provide any support with regard to those licenses. The JDA Demand Management and Reporting software is essential to the DLA’s ability to statistically forecast future customer demands, execute the replenishment of the DLA Inventory within the Supply-Chain Network and report on the availability of materiel, thereby precluding consideration of a product manufactured by another company. Only the JDA software maintenance can meet DLA’s needs.

Failure to procure this annual maintenance will adversely impact DLA’s demand and supply chain planning and optimization processes. JDA software plays a major role in supporting DLA’s overall supply mission. Without renewing JDA software maintenance, DLA risks being unable to determine who (our customers), need (over 4 million NIINs), when (time-phased inventory plans), where (to position the stock), and quantities needed for the customers of the three Major Subordinate Commands: Aviation, Land/Maritime, and Troop Support. In addition to the loss of accurate data, using software that is unsupported, functionally out-of-date jeopardizes information assurance security and accreditation. Loss of accreditation will result in the Defense Information Systems Agency (DISA) revoking DLA’s authority to operate the EBS data center and terminate DLA’s ability to perform the critically needed supply chain mission resulting in potentially catastrophic mission failure.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS

REQUIRED BY FAR SUBPART 5.2 AND IF NOT, WHICH EXCEPTION UNDER 5.202

APPLIES:

The Contracting Officer conducted a review of the General Services Administration (GSA) Information Technology (IT) Schedule 70 contracts and DoD Enterprise Software Agreements to access whether any vendors provided the required software maintenance. The search resulted in no other vendors available to deliver the requirement. Further, the Contracting Officer engaged JDA/Blue Yonder Software Group, Inc., and confirmed that it was the only authorized sources of the Demand Management and Reporting software licenses and maintenance.

The market research demonstrated that there are no authorized resellers of JDA software and maintenance. JDA Software Inc. is the only known firm that provides JDA software and maintenance. Therefore, the proposed acquisition will be solicited on a sole source basis to JDA Software Group, Inc. A Combined Synopsis/Solicitation - Request for Proposal (RFP) will be sent directly to JDA Software Group, Inc., and will be made publicly available together with this sole source/brand name justification on the Federal Business Opportunities (FedBizOpps) website in accordance with FAR 6.305(c).

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.414-1. It is anticipated that, in order to obtain a fair and reasonable price, the Government will use various price analysis techniques including, but not limited to, the following: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-1(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-1(a)(2)(iv)); and 3) comparison of proposed prices with prices obtained through market research of the same or similar items (FAR 15.404-1(b)(2)(vi)). The contracting officer will determine the prices fair and reasonable prior to award using the above comparisons along with historical pricing.

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS:

JDA Software, Inc. is the only firm that provides JDA Demand Management and Reporting software licenses, and software maintenance for the licenses. DLA has promoted and continues to promote competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government as a continuing effort within DLA. DLA always uses a variety of vendors, manufacturers and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition. No other firms are known to provide the brand name “JDA Software Group” software licenses and maintenance/support required.
